Hello all,

 

My fiance is an Australian trying to immigrate to the US on a K1 visa. We received NOA1 (application received) in December 2019 and NOA2 (approval) in April 2020. However we haven't heard a single word since then. The theoretical next step is the NVC receives the case and forwards it on to the US Consulate in Australia. It's safe to blame the pandemic for the delay in the process but we would have expected to receive SOMETHING, especially this late. We have contacted USCIS and NVC numerous times for an update and receive a generic response each time or no response at all.

 

We have already canceled our wedding. We are coming up on 6 months since last seeing each other due to the travel ban in and out of Australia. We are looking for any kind of reassurance that our case is still active and hope that we will get the visa soon. Has anyone else been in the same boat as us? Or, has anyone seeking a K1 visa to the US from AUS been successful in the same time frame? Does anyone have any advice on what kind of next step we should take? We are on our last legs, we don't know what else to try to get some kind of support or answers. It's been an absolutely drain on our mental health, we are both struggling tremendously.

My advice:  Be patient.......the pandemic has caused the progress of most K-1s to stop.  There is nothing you can until individual consulates resume K-1 processing.  A separation of 6 months is nowhere near out of the norm for immigration.  Relax.....your time is coming.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Check out the thread below for updates from others who are also waiting on the consulate in Sydney.  A few there have reported getting K1 interview slots recently --

You're new to VJ, but do some reading here.  Nearly every K-1 applicant is in the same boat.

 

All you can do is wait.

Applicants were never promised when something will be done or that you will get a "sorry" notice.

 

We have contacted USCIS and NVC numerous times for an update and receive a generic response each time or no response at all.  There is no other response because the pandemic has stopped everything but the good news it's beginning to open for some embassies. Stay in touch with your embassy and when they reopen you will see CEAC.state.gov change but you must have a case number from NVC to search for the current NVC status. There are millions in the same boat as you. So many your boat is on the verge of sinking. :rofl:processes Sorry had to add a little humor. Yes, there are others just like you. It's rare that a case will get lost or lay waiting months or years for someone to claim. USCIS, NVC and your embassy have good process's to keep your file safe. So, don't worry, you're in line but we can't say where.

I'll share something with you that I learned long ago about this process.


    • "the man with the gold makes the rules"
    • it will take as long as it will take 
    • no one with any certainty can tell you when some process will be completed
    • Your sense of urgency will never be equaled to what USCIS, NVC or your embassy demonstrates
    • Your journey is not going to mirror someone else's experience - yours and theirs are not the same
    • They only promised you a YES or NO answer. Never an exact time that their decision would be completed
    • Lowering your expectations will make you a much more relaxed individual
