I-751 Filer Travel Question (expired green card with I-797C))

Hi all,

 

My wife is in the US with an expired conditional green card (expired April 2020). We filed our I-751 in early March 2020, and got our I-797C a few days later (The case status page says Case Receieved). We havent received any communication from USCIS regarding a biometrics appointment or for an interview.

 

My wife would like to travel abroad to visit family (Nov & Dec 2020), and I would join her for Dec 2020. We plan to be back in the US before 2021. My question is whether this sort of travel is possible without any issues?

As long as she brings both the expired GC and the extension letter, she shouldn't have any trouble.  When my husband traveled internationally with his expired GC we also had extra copies of both the GC and the extension letter in both of our bags just in case.

3/19/2021: Email notification that USCIS has taken action on our case

5/5/2021: Interview in Lawrence, MA (our field office is Hartford, CT)

5/5/2021: Approval and same day oath ceremony due to COVID-19!

You have not specified if you have an extension letter. If you do and it is valid during your dates of travel you can travel without issue. If you do not have an extension letter she can not travel.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thanks. Yes the I-797C states an 18 month extension. My worry was regarding the biometrics and/or interview, if it comes while we are out of the US.

Same here. I applied in May 2020, and want to travel in january 2021 but do not want to miss my fingerprint appointment. I would wait till december to see if they are going to apply my old fingerprints or not

So we did biometrics, now I see the USCIS online status as:
Case is Ready to Be Scheduled for An Interview. As of January 6, 2021, we are ready to schedule your Form I-751, Petition to Remove Conditions on Residence, for an interview.

I'm assuming the interview date is going to be months away, any idea when?

We're in Austin, TX. I remember filing the I-751 to Dallas, biometrics were done here in Austin. Although if I look at the I-751 address now it seems to only be in Arizona. 

@Mill&bill Did you get your biometrics yet? I see you wanted to travel earlier.

yes , my biometrics appointment was on 12/10/2020. status change to finger print received. No update regarding interview. I am in california
