In the event this alleviates any concerns for those in mid-2025: I have a pending I130 and have visited the US twice so far this year (April and June) on an ESTA without any issues. Both of my trips were for around 2 weeks and the CBP officer was comfortable with my explanation and intentions.

Just further adding to this, I visited for a week again in mid-August 2025 on an ESTA.

This time the questions the CBP officer asked me were:

  • When  was the last time I visited?
    • I said May/June
  • Purpose of my visit
    • I said to visit my spouse
  • They asked if they live in the US
    • I said Yes
  • They asked to see a return ticket
    • I showed them the flight itinerary on my phone

And then everything went ahead as normal.
