  1. You can not get a Tier 2 officer on the phone when you call USCIS. Speak to a Tier 1 and put in a request for an officer to give you a call back as you are outside the USCIS processing times. They will put you in a que to recieve the call but it might take awhile. I know this as I have been battling them over an expidited request that I had put in over a month ago for a medical issue. Also reach out to your senator, as well the CIS Ombudsman. Good luck and don't give up or let up.
  2. I'm a fellow December 2023 filer too. My processing time went from 6 months-5 months-4 months-3 months (it stayed at 3 months for 2 months) and now it is at 7 months. I wouldn't pay any attention to how long it says on USCIS because all you are gonna do is get excited and become disappointed when they add more time.
  3. Even if you file an expidited request, don't expect anyone at USCIS to look at it in a timely manner. I filed one over a month ago due to medical issues and they haven't even assigned an officer to look at the request yet. USCIS truly doesn't care about us.
  4. There is no 90 day rule. Just go back to your home country before your visa waver or visa expires and then have your fiance file the I-130 petition.
  5. When they ask what your intentions are in the United States, they do not need a play by play of everything you are doing. As long as you marry and then go back to your own country afterwards, telling them you are "visiting my boyfriend " is enough. There is nothing illegal about getting married while you are a visitor and it won't bite you in the butt later. Now if you come here with the intentions of getting married, staying in this country and trying to adjust status then yes, you misrepresented your intentions upon entering. Honestly, all CBP cares about is that you will be returning to your home country. I'd you volunteer the fact that you are getting married, they will be paranoid that you are going to try to stay in the country instead of going home. I talked to 3 different immigration attorney before I married my husband and they all said that it is perfectly legal to marry and him return to his home country afterwards.
  6. All documents not in English need to be translated by a certified translator. This includes her birth certificate. Make sure to send the translations in with your I-130 petition.

  8. I actually really like RFK Jr. After going to his presidential site and reading his plans how he would help the country, he will definitely get my vote provided he is on the ballot in Texas. He has detailed how he'd fix almost every issue our country is already facing. His border plan is actually pretty good. Definitely a much better solution that Biden or Trump have come up with. One thing is for sure, Biden won't get my vote.
  9. Be honest about the nature of your visit and who you are visiting. Have a return ticket home and proof of ties to your home country. Make sure you don't plan to stay too long or they will question you, with or without an I-130 pending. Learned that the first time my husband came to visit when we arranged for him to stay for something like 84 days. They almost denied him entry. Last time he came, he stayed 5 weeks and no problems.
  10. Oh I submitted a lot of pictures of us together that included mutual friends and family in them. A couple were from Christmas 2022 with my family.

  12. He has a been in trouble for with the law for theft when he was under 18. There was 2 separate incidents. An attorney said it might be an issue. I'm hoping that they just fell off his record.
  13. Hello everyone! My name is Tiffany. I am a US Citizen from Texas. My husband Mike is from Hamburg, Germany. Our story is kinda different. My grandfather met my grandmother when he was stationed in Germany during WW2. They fell in love, got married, had 4 kids and she immigrated to the states. My parents divorced when I was 6 and due to family drama, I didn't really get to see my grandma or talk to her growing up. I was completely estranged from that side of my family and even struggled to have a meaningful relationship with my father even as an adult. Unfortunately both my grandma and father have passed so the opportunity to learn about my German heritage from them has passed. I met my husband Mike in the late spring/early summer of 2022 though a video game that we both played. When I found out he is in Germany, I struck up a conversation with him about it as I've always wanted to visit there and learn about my heritage. Our conversations started off just about what life is like in each other's countries but then we started talking about our morals, past relationships, ect. After about a couple of months, we were talking for hours every day and spending every free moment we had together. Feelings really started to develop and we decided for him to come here to visit and stay with me for almost 3 months. We wanted to see if what we were both feeling was real or if it was just infatuation. He arrived here in December 2022. After having him here with me for a week, I just knew he was the one for me. On Valentine's Day in 2023 he proposed to me. Sadly 2 weeks later he had to go home. We decided that he would come back to spend my birthday with me. On September 10th, 2023 Mike and I along with my sister and husband took a trip to Las Vegas and were married that night. I originally filed the i-130 in the beginning of November, however due to a typo on my credit card authorization, my petition was rejected. The petition was then re-submitted in the beginning of December 2023 and currently it is the "case is being reviewed" status. Yeah like I actually believe that. Our journey with the immigration process has just begun but the anxiety and stress are already getting to me. I find myself waking up to being in a full on anxiety attack quiet frequently. I'm always thinking about the possibilities of things going wrong and having to file a waiver of inadmissibility.

As a collective group, we need to come together and figure out exactly which senators are highly anti-illegal immigration and very vocal about it and just flood their office with letters, asking them to be the voice for those of us who are trying to bring our families over here. The only politician that I have heard mention anything about coming over here the legal way is Nikki Hailey. She has stated that her parents are immigrants and they are appalled by the illegals .
  15. I asked my attorney's paralegal about what official documents from me my husband will need for his interview so that I can bring them with me when I go visit him in a couple of months. She told me that he will need offical certified copies of my birth certificate, our marriage license and my divorce decrees. If you can not find your late wife's death certificate, you should be able to go to the county clerk and get another certified copy of it.
  16. My husband and I use Skype which don't let you export media. I just submitted 2 or 3 screen shots of our chats and talk history per month since our relationship began to the time I filed. We are doing the exact same thing during rhe months between filing and his consulate interview, except he will bring those with him to the interview.
  17. Once USCIS receives your petition, it is too late to submit additional evidence. Any additional evidence you have obtained since filing your petition can be presented during your wife's interview. I had additional evidence after submitting my petition and this is what my attorney told me.
  18. After talking to about a dozen different Immigration lawyers, I obtained Solomon Immigration located in Florida to handle my case. All his lawfirm handles is K-1 and CR-1/LR-1 cases. So far, I have been pretty satisfied with this law firm. He charges $350 a month for 8 months or you can pay upfront for $2,500.. I know others keep saying that it is not hard to do it yourself and that a lawyer is a waste of money but I think differently. The paralegal assigned to my case has been extremely helpful in how to format my pictures, how to my family and friends affidavits, ect. She and Mr. Solomon know how to wrap up my petition in a pretty package for USCIS. Basically a good attorney is going to make sure that every single document you need is there before being sent to USCIS. They will also help prepare your fiance for the interview.
  19. Has anyone had their medical exam done in Hamburg, Germany? If so, do they take Visa or Master Card?
  20. You have to submit every single document at the same time to USCIS. The marriage document has to be included with the petition. And the marriage has to be legally recognized in the country in which it occurred in. Also, if your marriage certificate is in any language other than English, you have to submit a translation of it. And you are not allowed to do your own translation. I had to have my husband's birth certificate translated. For example my husband and I were married in the US so our marriage certificate is valid here in the US. However it would not be valid in Germany because of the Haute Convention unless we had an apostle (the secretary of state in whatever state you marry in) sign off on an additional form. Our marriage is 100% legit and recognized in the country in which we were married so it doesn't really matter that it isn't recognized in his country. I just submitted my I-130 petition to USCIS last week. I hired an attorney to handle my case for me as there is going to be a red flag on my case due to the age gap between my husband and myself. Anyways, if your wife would want the help, I would be more than happy to help her with all the documents she needs to gather to submit to USCIS. I'm offering help because it would be nice to have someone else to go through the process with.
  21. My husband and I got married a couple of months ago in Las Vegas. We paid the chapel an extra fee and had our marriage certificate back the next day. He was on VWP when we got married. He went back to his country a month later and then I filed the petition. Nothing illegal about this as he went home and we are going through consular processing. I talked to several lawyers before doing this and there is no law against it.
  22. If it were me, I would not quit the job til after she gets here. I personally think it looks better to have tenature at your place of employment as it displays stability. I've wanted to change jobs for awhile now but am holding back til we finish the process because of this. Could you transfer to a different department or location? Or just reduce the hours there and pick up more in exchange at the other job? Ultimately the choice is completely up to you, I'm just trying to give you a different perspective and options.
  23. in my opinion, no news is good news so far. USCIS is notoriously slow, no matter what center is handling your case. I believe the current processing time is up to 14 months. I would contact them to inquire about your case when the 14 months is up. How did you file your petition? Did you do it yourself or did you retain the services of an attorney? The fact that you had previously petitioned for your ex-husband will more than likely be a red flag. I am sorry that he was a cheating dirt bag by the way. And depending on the age gap, that might also be considered a red flag as well. I have a large age gap with my husband as well so I went above and beyond to submit as much evidence of our bona-fide marriage as possible to over shadow that red flag. The best advice I can give is to remain calm, don't stress out and follow up with USCIS. This whole process is stressful enough without us adding to it. Whenever you start to stress just remember that you aren't alone in the process and that us here on this form are going through it with you. Best Wishes
