Mirla, when I was told to call and not enter my case number, i am not sure if it was customer service. All I know is that I said i needed to know the status of my petition and that i was conserned because i never received a hard copy NOA1 and if they could please confirm they have my correct address. She, without asking me my case # she put me on hold and transfered me to an officer. The officer asked for my case #, confirmed my address then told me I was approved since Oct. 15 and that I should receive a letter in the mail because they did indeed have my correct address.

Hope this helps, girl! Keep insisting. You either have an rfe or something is not right. Best of luck, we are all pulling for you.

Sorry if I'm butting in here and being off topic, :blush: but ZeeNusah, I can't help but notice your interview date is in like March?? It's like 5 months away! Why such a long time if you don't mind me asking? Just curious... ^_^

I know. Its a long time. But in Ghana the wait is 4-6 months.

I know. Its a long time. But in Ghana the wait is 4-6 months.

I'm so frustrated with this tonight. Just returned from visiting my fiance and wish I had just stayed. It bums me out to think even if our NOA2 arrived tomorrow, we still have 6 months on the other side of it. Stupid "Ghana time" - it's an American Embassy, it should run on American time (better: New York time :yes: ). Hang in there Zee, as bummed as it makes me, it gives me hope to see your time line moving towards the entry date.

I think that the new officer who signed for their petition started working at VSC in September and he is working only on the packages he signed for...so then every package he signed for will skip all the earlier petitions that were signed for by Mr.Novak... :unsure:

And where did you get that information??????

If that were the case only P. Novak would have been working at VSC and we would all still be waiting. Do you really think there is only one person who works at VSC?

And how do you know the new officer was hired in September?

If that were the case many more September filers would have been approved by now.

There are many many many people who work at VSC.

Do not go around making statements like that. Too many people here are already stressed about the whole process without throwing in bogus, erroneous information.

He also said VSC is processing April 18th application....he put me on hold for more than 5 minutes, two times and asked me if my petition was a K1 or K3..........so one more time that proves, they don't know anything.

Honestly were you expecting any different. Not only will you not get the right information, you will NEVER get the same information twice.

Mr. Paul Novak is the Director at VSC. Does anyone honestly think he is sat there signing anything ....other then the back of his paycheck.....???!!! The P. Novak signature is no different then the form letter syndrome that seems to run amuck in our government offices..... *winks*

Folks,

I am getting quite tired of waiting and waiting. I wish I could take time off and visit my fiance, but can't because of work.

She does have a tourist visa and has visited the US 4-5 times in the past, before we were engaged. Can she use that tourist visa to visit? I have read the forums/guides.. but wanted to find out from this tight knit group as we have communicated frequently and I have a particular level of trust in this support group.

Your perspectives would be highly appreciated in maintaining my sanity.

Waiting9, you have the correct ID for waiting...actually I should of had that too. In seriousness here...

Please read the below paragraphs. Personally, I would not chance it without something in writing from the US embassy or consulate where they got the tourist visa. They need to explain the situation of having a tourist visa and also currently processing a K-1 Visa. The stakes are too high…all the way from being turned away at the entry point to being banned. It is my opinion that you are better to be very safe than sorry with this situation.

One question I am asked regularly is "Why can't my fiancee just come using a tourist visa or on the visa waiver program and marry me?" The problem is that a main condition of both a tourist visa and the visa waiver program is your fiancee's sworn promise that they only plan to visit the U.S., not immigrate here. The Department of State ("DOS") and United States Citizenship and Immigration Services ("USCIS") assume that an intent to marry a U.S. citizen is the same as an intent to immigrate. If your fiancee enters the U.S. as a tourist, without disclosing that they are your fiancee and intend to marry you, they have committed visa fraud. If the USCIS later decides that this is the case, they could be removed (i.e., deported) and it will be almost impossible for them to come back, even though they are married to you.

.....OK....more new news......After finding out yesterday bout the RFE i called my lawyer right away.....I let her know that i knew for a fact that it was sent on the 18th and that there is no way it would take more than this week to arrive...I left that on an aswering machine....well today first thing i called her again and explained everything...she said "well i have a huge pile of mail which i will try to get to today or tomorrow" i told her i want news by friday the latest.....Well late this afternoon she left a message on my cell telling me that the RFE letter was in the pile....And to top it off...the evidence that they want...your going to laugh!!!! She forgot to have me sign one of the forms...that is all they asked for... :wacko: .....NEVER EVER DEPEND ON A LAWYER!!!!!!!!!!!!!!!!!!!!!!!!!!

Well tomorrow im going to her office to sign it and im sending through my Fedex account right away!!!!!!!!!!!!!!!!!!!!!!!!!!

Unbelievable, Byron. I sure hope they take care of you immediately when you FEDEX that back. I can't believe the number of complaints I have heard about folks' attorneys in just the short period I have been a member of VJs.

By the way, you would think one of their scrubs that process those in would check for the most basic things such as a missing signature and not have it wait 5 months until an actual adjudicator gets it to turn it back to the petitioner...jeez oh man...

If she has a tourist Visa she may be permitted to enter if she shows enough ties of proof to India. It is NOT illegal for her to visit. You just have to know that its a gamble at the POE. If the officer beleives she will stay, rather than return to India, she will be turned away. BUT if she can show strong ties to Indai - job to return to, mortgage or lease payments, etc., she could very easily be pernitted to enter. Check out the thread titled, Yes! You can visit. Its in the K1 questions forum. A very interesting read of personal experiences of fiance/es who have visited whilst K1 was pending. Don't be afraid, be informed and make an informed decision based on that info. Cos as I mentioned before, there is NO LAW that says you can't visit! Good luck!
