Need help regarding i864 for CR1 and CR2. Since I filed 2 separate i 130 one for spouse and one for my step child living abroad

Can anyone out there to help with this question. On the DS 260 (filing for step child ,in this case), they ask " list your biological parents or adopted ? I filed for my step child , the child is 19yr . what should be the answer. should I give Child's biological parents info or my info as a step father of the child.

Certainly not your name.  You are neither the biological or adoptive parent of this person.  It's a simple question.  Interpret it literally and answer it accurately.

Hello Guys

1. what should I do if I can't type few enteries on the i864 form using computer . There are few entries already filled on USCIS form. such as form  i864 , part 5 regarding household size , the last entry has 1 in it. I  can't override it since its inactive. should I print is as such and then use white out to change the size number.  Any suggestion that can be acceptable..with NVC..

2. ALSO, can I use black pen where I can't type on i864 pdf reader, its seems like inactive .I tried updated versions of such form and there are few columns inactive .can I print it and  use black pen there instead.

Yes, you can print it, write it in black or blue ink, and scan it back onto the computer

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

When it comes to household size on the downloaded PDF of the I-864, if it is not correct, it's probably a mistake on your part.  Of course it starts with a 1, because YOU count in your own household size.  If you've entered 1 as the number of immigrants sponsored, that automatically changes the bottom total to 2.  If you've added any other numbers, they get totalled.  What exactly is the household size you believe to be correct, as compared to what the form shows?

The most recent updated version of i864 on the uscis website , part5, item 2 contained number 1 already. Thats ok , I tried typing item 1 with number 1 but it didn't allow me and item 8 , contained number 1 already, I couldn't able to change it with 2. 

since I am filing this i864 for my spouse and I am the petitioner. I understand that household size will be 2 here  . I have no other dependents claimed on the tax return. And I understand that household size will be 3 on my stepchild i864 one, child is 19yr old and both beneficiaries living abroad.

 

can I make 2 of 1 in item 8 with bulk pen. what should I do...

Looks like you left part 3 item 29 blank.  Type a 1 in there and see what happens.

They'll both be the same if you just enter 1 in Part 5 number 5 as your step child is another dependent.  It doesn't matter whether the child has appeared on a tax return yet.  They ARE your dependent.

On i864 part 5 , item 4 , where it says enter 1 for dependent children. The number will be 0 , i hope in my case.

If u read instruction for i864 , part 5,  item 4, it says type number of unmarried children under 21 even if you do not have legal custody of such children.  THEN it says , you may exclude any unmarried children under 21 if these children have reached majority under the law of their place of domicile and do not claim them as dependents on tax returns. 

I don't claim my child and she is 19 yr old , attained majority age of 18 in india...

Moreover, I filed 2 separate i30 one for spouse and for my step child. 

What would u say now....u can also see the answer of this on this forum where NikLR has answered the household size 2 in spouse i864 and 3 in step child i864 . Plse clarify
