Intent to Marry RFE Amidst Covid-19

Timeline

We received the following RFE as part of k1-visa journey.

Our original plan was to get married at City Hall in the San Francisco courthouse. Previously, we did not provide any booking confirmations here, and plan on doing so now. However, the courthouse is currently closed (see here: https://sfgov.org/countyclerk/marriage-general-information) and no online, or in person reservations can be made.

 

So my question is, how I can we provide evidence for the booking reservation in this situation? We are planning to make a call to the court house and explain the situation, and at a best case scenario, receive a confirmation on interest of some sort.

 

Beyond this, we are also planning to also provide the following information.

 

Evidence of wedding preparation

* chat history

* courthouse booking for marriage


Evidence of ongoing communication

* chat history, birthday celebrations, new year, personal letters sent

* call histories

* chat export, and analysis on the text, such as messages sent, frequency of messages sent per week, etc.


Correspondence discussing your future and/or marriage

* chat discussion on career, education, medical, housing, kids, etc


Evidence of financial support

* money transfers for support, and bank statements

* tax return

* financial relation discussions on chat


Evidence of subsequent meeting

* meeting phones, discussions timeline form, plan tickets, booking reservations, passport visa, planning iternary


Evidence of an engagement ceremony

* <this goes in light on the question proposed (ceremony planned in SF courthouse)>


Evidence your and/or the beneficiary's family and friends are aware of the relationship

* communication with parents, both sides (video chat) with screenshots

* communication with siblings and friends

* evidence for plan on second trip for meeting parents, but having to cancel due to covid


Birth certificate of children born to the relationship

* N/A

 

Any other evidence that might shed light on the intent to marry.

 

Any additional advise would also be appreciated.

You're missing one of the most important items - signed letters of intents to marry.

Did you send those originally?

Yes we did (from both parties, signed). But we are planning to send it again for completeness.

Great. I think you'll be fine with the items you noted.

 

As for the reservation, I would just include a letter stating your plans but are unable to proceed given the current COVID-19 situation.

That said, it is nearly impossible to give a firm date for a wedding when it comes to a K-1. The process can take many months longer than one anticipates - either due to new backlogs or something specific to one's individual case. They aren't looking for a firm date - just plans.

That is very true. I am was under the impression that they were looking preparations written in stone. Paranoia from the rfe got me.

For the I-129F all you need is a letter with 2 sentences.  Most of that RFE is boilerplate.  You cannot plan anything until you get the K1 visa

 

Can you post your letter of intent (with names etc redacted) so we can see why they would ever question intent to marry from the Service Center?

 

From the consulate?  OK, that would make more sense.  From the CSC?  Something is amiss.

We followed the examples provided from visa journey. What would be amiss if it comes from csc, as opposed to the consulate?
