What if my K1 visa expires before I receive my NOA for AOS?

Hello, everyone.

Recently, I got married and submitted my AOS, and the package was delivered with signature (according to the tracking information) before my K1 visa expires. However, I have not received the NOA for the applications yet, and my K1 visa will expire soon. 

 

Questions:

1. Do I have to apply for the extension of my K1 visa or other things, since I do not think that I will receive the NOA before my K1 visa expiration date, and I will not have any visa after it expires till I receive green card?

 

2. What should I do if my application for AOS is rejected or denied? Can I apply the AOS again even my K1 expired?

1.  Your visa expired the second you stepped into the US.  You have 90 days after entry to marry.......then once you have submitted a proper I-485, you will be granted authorized stay until the I-485 is adjudicated.  

2.  Yes.  Properly Reapply asap.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

1. There is no extension at all. As long as you sent it in then you should be good to go. When did you send in the petition?

 

2. You can refile your AOS application. Why do you think it will get denied?

1.Good! I was wondering if I had to have an evidence to show that the office receives my package before my K1 visa expiration date or not. I sent it in mid-March, so I expect to receive the NOA by mid-April, because it may take about 30 days, right?

2.I read the stories about people who got denied, so I was worried if it would happen to me even I thought I sent all the documentations they need...

You are paranoid for no reason, K1 visa is for getting married within 90 days not for AOS. AOS process doesn't depend on its validality. Don't be stressed on it, you still have a long way ahead. Good luck.

The main requirement is getting married within the 90 day window not getting married and then sending the AOS package off. Correct, It can take up to 30 days to get the NOA1. So if you haven't received anything by the 20th then call them up.

 

The biggest reason while people initially get their petitions denied is 1. Lack of documentation 2. Using old/outdated forms 3. Wrong Payment
