Hi, I managed to enter the US on a K1 visa from the UK just before the travel ban went ahead. We are now legally married and wanting to file for adjustment of status. I have tried to look for the answers to these questions on other threads but have struggled so I apologise is these things have already been answered.My questions are as follows:

 

1) We were going to include my husband's mother as a household sponsor. She makes $29,000 before taxes, we were then also going to combine with my husband's income as he doesn't make enough alone. However, due to the coronavirus my husband has lost his job. I therefore understand it is better for us to use his mother as a joint sponsor, not a household sponsor, as my husband is currently unemployed. So, my question for this is as follows, what is considered to be the household size and therefore the income requirement that my husband's mother must meet? Currently in the household is her, my husband, her daughter (16) and her other daughter (21). So how much would she need to make to qualify for this?

 

2) I understand the USCIS offices are closed so interviews can't go ahead etc, so is it worth waiting to file? I understand from what I've read there are still people in the offices and that extensions wont be issued. Just not sure what the best thing to do in this circumstance would be.

 

3) If my husband files for unemployment will this affect anything at all? From what I've read it seems not, but I just don't want to do anything that will look bad. Obviously he will try to get a job asap, but this has always been a struggle in the past and with the way things are right now, I can see this being difficult.

I was wondering if you made it. Hope all is well. At least partly well anyway. Losing a job is tough.

 

File when you can. It should at least put you in the queue with an earlier date.

Her household is

1. her (mum)

2. the immigrant (you)

3. The 16 year old

? The 21 yr old if Mum claims her as a dependent on her 2019 tax return

? Your husband if Mum claims him as a dependent on her 2019 tax return.

 

The two older may make their own money and file their own returns. Ask mum how many are listed on her tax return.

3– $27,150

4?  $32,750

5? $38,350

 

By the time you interview, your husband may be employed and you can take in a fresh I-864 for him.

I recollect you were asking about Health Insurance and wanting to travel back, for that you will need AP. Also sounds like you need work authorisation.

The mom's income is quite low in all honestly, for most regions of the US.  Per the FPL charts used by USCIS it may be borderline.  Hopefully he will have a new job by the time the interviews take place.  All of the major big box companies are hiring like crazy at the moment.
