Hi guys, 

 

I'm the US Citizen spouse. I was stupid and haven't yet filed my 2017 tax return. I believe my only income that year was a withdrawal from a retirement account that I would have owed tax on. 

 

Anyways, I'm now in the NVC stage of petitioning my wife in the Philippines. I'm worried of what will happen once I file it late. I know it's required to file. 

 

Will this potentially disqualify me from petitioning my wife? Anything else I should be concerned about? Thanks as always!

Late filing will not disqualify you......failure to file will.

Senior Master Sergeant, US Air Force- Retired (after 20+ years)- Missile Systems Maintenance & Titan 2 ICBM Launch Crew Duty (200+ Alert tours)

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Exactly! sooner you file the better off you will be. Avoid as many penalties as you can for a late filing. Now might be the time to file as the IRS may even waive the late fees, and you just pay what you owe. Doesn't hurt to ask.

 

Another thing, depending on the type of retirement account you withdrew from, you may have already paid the taxes on the money when you took it out, so you could be in the clear.

Wow thank you for the advice! So if I am filing 2 years late would I need to worry about being charged criminally? Really scaring me...

No, my CPA has filed taxes for people that were over 7 years late she has said before, never a mention of anything criminal. Now if you pull a Westley Snipes and stash a few million in another country to avoid paying taxes on it I would expect some criminal charges filed, but otherwise I have heard of a lot of people filing late with no issues.
