Timeline

Just received letter in mail from USCIS requesting 'a complete Federal income tax return submitted to IRS for most recent tax year.'  In our AOS package I-485 we submitted last 3 years transcripts for '16'17'18/ I am assuming they need actual copy of the return that was send to IRS for 2018 not a transcript?  we haven't filled for '19 as of yet. Correct me if I'm wrong please.

Hi! I got the same RFE last month and sent in my 2019 tax forms (I had literally just filed taxes the week prior). I assumed they just wanted 2016-2018 as well since we filed for AOS in December, but once I sent in my 2019 tax forms my case changed to “Ready to Be Scheduled for Interview”.

Okay, It seems like its happening to many people. I will jump on those taxes asap! thank you for your input.

Are you guys saying that if I send IRS tax return transcripts for 2016, 2017 and 2018, it won't be enough?? 

 

I am confused.. 

 

My husband hasn't filed taxes for this year yet.

The deadline to file taxes is coming up soon, so it may be beneficial all around for him to just file now.
 

We filed our AOS petition for my husband in December of 2019 and they asked for the most recent tax documents in February which I assumed meant 2019 so I went ahead and sent that in. On my letter it listed W2s as an option so I printed out mine and sent those in and that’s when our status changed to ready to be scheduled for an interview. 
 

I know that’s not a straight forward answer but you never know until you get the RFE. If you can send the 2019 as well that may be really helpful since that would probably be considered the most recent as of today. Hope this helps.

I really had not realized that they would ask for 2019 since I have read the forms' instructions so many times and here is what they say

So I had told myself to just make sure we had that for the interview as stated. 

They call 2019 , the "curren tax year", and to my understanding "the most recent tax year" means the most recent one that I was able to file. 

 

 

So what did you send exactly for 2019?

The w2's?

No IRS tax return transcript right? 

 

I just need to make sure I don't send the wrong stuff..

Okay, so ignore my answer because we weren’t under the Public Charge rule when we filed so someone who filed after the deadline would probably be more helpful for you lol so sorry. We didn’t have to file the I-944, so I have no idea what that form entails.

I’m so sorry! Lol My RFE was for the tax documents for the I-485. All we filed was the I-485, I-765 and I-130.

Oh so I do need it too then, because I'm filing the same documents as you. The tax documents are required in the i-864.

 

So, since an IRS transcript won't be available yet by the time I send my packet, what can I send for 2019 if we file electronically today?

W2s only? Or is there something else? I'm not so familiar with US taxes yet.

If you want to include your 2019 taxes (you don't have to since the deadline hasn't passed yet) then you print out the tax return (if you're using something like TurboTax or HR Block there's an option to download a pdf of what they will electronically send) and with it you include a copy of the documents that you used to fill in your tax return (W-2s, 1099s, 2555, different schedules, whatever is applicable).
