Interview with overstay??

Hello. Can anyone fill me in on their experiences with interviews after over staying?.. I just got notification that my EAD and AP have been approved so I’m starting to think ahead to my interview (hopefully that will be scheduled soon).  I overstayed here for about 2 years- yes I understand it was not the right thing to do but I could be doing without any negative comments. And if I could go back and change that I would. 

 

anyone in the same situation who has had an interview and can fill me in on their interview experience? I know they go thru the yes and no questions and one of them asks if you ever violated your immigration status (or something along those lines) and obviously I had to answer yes. For the over stay

I don't have any experience but all I'd say is answer everything truthfully so that you dont get into any trouble

AOS  (I-130, I-130A, I-131, I-693, I-485, I-765) from H1B, based on Marriage to a USC:

12/11/2019 - Package mailed via USPS

12/12/2019 - Package delivered

12/23/2019 - USCIS cashed the checks. Received text notifications from USCIS with case numbers (12/12 - Case was received, 12/19/2019 - Fingerprint fee was received)

12/27/2019 - Received the 4 NOAs in the mail

12/30/2019 - Received Biometrics Appointment scheduled for 1/10/2020

12/31/2019 - Biometrics Walk-In at Dallas, TX.  I-485, I-765 : Cases were updated to show that the Fingerprints were taken

01/09/2020 - EAD/AP expedite made (refer to my timeline for more details on this)

02/06/2020 - EAD/AP Approved

02/12/2020 - Received the Combo Card

02/14/2020 - I-485 updated to ‘Case is ready to be scheduled for an interview’

I-485 - Interview Scheduled at wrong state:

10/27/2020 - Received a text saying that an action was taken on my case

10/30/2020 - Received an email saying that an interview was scheduled - Case status : Testing and interview

10/30/2020 - Case status changed to 'Interview was scheduled'

11/04/2020 - Received the Interview appointment letter - scheduled in old state North Carolina for December 3rd

11/05/2020 - Called USCIS and requested to talk to Tier 2 officer - opened an SR

11/06/2020 - Received an email that the request was closed as they couldn't contact me - but they didn't

11/09/2020 - Opened another SR to talk to a Tier 2 officer

11/16/2020 - Tier 2 officer called and said that we need to interview at our home state, but I could take a chance and go to North Carolina.  So I requested to reschedule interview at Dallas, TX.

11/16/2020 - Received an email with a Referral ID and that my request was submitted to NBC

11/17/2020 - Received an email - my request to reschedule interview has been forwarded to a scheduling department

11/17/2020 - Received an email with my Case status: Testing and Interview and now it has the status - 'Request to reschedule my appointment was received'

12/31/2020 - We cancelled your interview

12/31/2020 - I-485 updated to ‘Case is ready to be scheduled for an interview’

01/12/2021 - Interview was scheduled (received an email as well)

 

EAD/AP renewal:

11/10/2020 - Shipped EAD/AP renewal documents via USPS

11/12/2020 - USCIS received the documents

11/18/2020 - Received 2 texts with the Receipt numbers for I-765 and I-131, Case Status was - 'Case was Received and a receipt notice was emailed' for both the cases. Received no emails though

12/01/2020 - Received the 2 NOAs in mail
01/06/2021 - We are producing your new card

01/08/2021 - We produced your new card - Card was picked up by the USPS

01/13/2021 - Combo Card was delivered to me

I can't tell by reading your profile, but if you married a US Citizen then your overstay is forgiven.   

March 2, 2018  Married In Hong Kong

April 30, 2018  Mary moves from the Philippines to Mexico, Husband has MX Permanent Residency

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Yes I’m married to an American, I just wondered what they would ask if someone over stayed

USCIS could ask, but like I said, by marriage to a USC an overstay if forgiven.

 

Note if you ever apply for a visa for another country and they ask if you have ever overstayed a visa the answer is yes.   My wife was denied visas three times.  Ironically twice for countries that she now has permanent residency in.

The question never came up at our interviews.    The IO even had his old passport with this I=94  and his visitors visa long ago expired.

NOID issued May 17th 2019

June 5th,2019   USCIS received my response on the  NOID// Addressed the NOID myself, No lawyer ever used in case.

July 1st, 2019  10 YEAR GREEN CARD APPROVED

July 5th, 2019   Approval letters for I-130 & I-485 received in the USPS  mail.

July 11th 2019   Green Card in Hand

Oh ok. How long was the overstay if you don’t mind me asking? I mean it’s no big deal I know it was the wrong thing to do anyway but I just wondered if they questioned it.

I've heard of people being given a hard time, depending on the officer. Keep in mind they are human.

But from a guideline standpoint you have nothing to worry about, you can adjust and the overstay will be forgiven if you have a straightforward case (no illegal entry, no criminal activity, no fraud). Don't lie, and you'll be fine!

He was out of status nearly a year when we married. And they never brought up his overstay at the interviews.
