Filing for K1 while living overseas.

I'm thinking about moving to live with my fiance while we wait on the k1.

 

But I know there may be some problems with that. I read that I have to keep a US based address which isn't hard to do I have family here.

 

The other issue is income. The question I have is when do I have to provide the affidavit of support? Is it during the initial application or during the embassy stage? 


Will I have to have a job lined up in the US already in order for us to receive the K1? Because I will likely be working in her home country at the time to some capacity.

Generally, your fiance will have to present an I-34 at the time of the interview.  No job in the US is necessary, but you or a joint sponsor will have to show proof of sufficient income to support your fiance....or proof of sufficient assets.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

That income will not be counted.

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Missileman already responded about your concerns
One thing to keep in mind is what happens AFTER. If they are granted a visa and both of you come back to the U.S., what's the plan?
Keep in mind that with K-1, fiance cannot work immediately until their work authorization or GC comes in, which is taking a few months right now. Am not sure how feasible it will be for you to get a job either. 

So please plan accordingly. If you are using a joint sponsor, they now have to have sufficient income to support you and fiance
AOS is currently $1200+.

So you can either

 

1) Have a job lined up already that meets the minimum requirements. Would that even count? Since I haven't actually worked there yet.

2) Sponsor


It sounds like this is very difficult to do without a sponsor unless I'm working remotely for a US company.

Either the sponsor or joint sponsor would have to show evidence of sufficient CURRENT income or adequate assets.  Current income is usually evidenced by pay stubs, current employment letter.

If you’re going to be living together overseas why are you doing a K-1? 

 

The K-1 is essentially an over-priced touristviss that allows the holder to travel to the USA to marry and stay. If you’re together somewhere already (please fill out your timeline and embassy!) then the beneficiary doesn’t need to travel to the US to get married - you can get married where you are or somewhere else close to you. You can then apply for a spousal visa which will enable your spouse to be a green card holder the second she clears the CBP area of the airport upon arrival. 

 

From past posts of yours, it seems the most important thing to you is being together as quickly as possible - by living with your fiancé overseas that has already been achieved. No need for a K-1 and its huge disadvantages.

 

Give your new spouse the gift of instant permanent residency - no AOS needed - and a cheaper visa process. She will thank you for it. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
