I was looking through my old I-130 petition (we were approved for IR1 visa in 2018 but didn't end up moving at the time and stayed in Canada, we are re-applying again).

 

In last petition for the question "Has anyone else ever filed a petition for the beneficiary?", I answered "yes" since I had petitioned for an I-129f for my spouse (before we were married). We ended up withdrawing that I-129f petition. However, I explained my answer to this question in the extra section provided in the I-130 form for the explanations and mentioned that I had previously petitioned for same beneficiary.

 

Now I realize that I should have answered "no", since I was the one who petitioned before and no anyone else. So, now I plan to answer it as no in the new I-130 form.

 

However, my question is does USCIS do an auto-comparison with previous petition and would this answer be flagged since it was answered "yes" before. Should I:

 

1. Just answer "yes" again and provide explanation in the explanation section of the form just like last time (that it was me who petitioned before) OR

2. Answer "no" but mention in an additional page/letter that last time I may have mistakenly answered "yes" but I did provided the explanation in the form (that it was me who petitioned before) OR

3. Just answer "no" with no explanation required
