Dating while married

This is not a problem at all.

 

My wife was separated when I met her, but still married. She could not divorce until she could prove separation for 1 year, and then having applied for the divorce it took a few months, so we were probably dating a year or so while she was still married to her ex.

 

It presented no problems during our k1 process. USCIS would have been aware that we'd dated while she was still married, as they had dates of our meeting/trips, and then her divorce certificate. They never questioned me on this at the interview at all. In places like the US where divorce can take a long time I imagine its not unusual for people to have moved on and started dating before the divorce is finalized.

 

You just have to ensure that the divorce is completed before you can file for k1 (as both parties must be free to marry when you file).

Timeline

Here’s my timeline: Separated from ex husband October 2016. I filed for divorce in Feb 2017. Started talking to fiancé August 2017. Ex husband officially moved out October 2017. Served ex husband divorce papers April 2018. Met fiancé July 2018, became pregnant. Divorce official October 2018. Filed petition November 2018. We are in final stages. I don’t think it came up at the interview.
