Hi everyone!

I need your help...

My interview was supposed to take place this Wednesday but I postponed it to December, 18 (only date available) because last week, I discovered that my Canadian police certificate was under the mention : Visa and not Privacy act. as required. I didn’t have the time to get new one in this short amount of time.

The problem is : The 4 month period for the petition validity goes until November 28 th. I asked an extension of my K1 visa petition by email to the consulate but I didn’t have an answer.

Will they do it automatically? Do I have to send something else?

This situation is very stressful and I need your opinion about it!

Thank you

Most of the COs at the interviewing embassies/consulates will automatically extend the validity dates of yet to be processed approved K1 visa petitions. However, it is up to the discretion of the CO. Since you are talking about an approved visa petition in Canada, likely the Montreal consulate, you should likely ask you country-specific question at the Canada Regional Forum, in order to get a more focused response.

https://www.visajourney.com/forums/forum/93-canada/  Reviewing the first few pages of the forum topics, a posting in Sept 2019 specifically mentions a new Police Cert. process in place. You could have been ahead of the game if you had checked in there....  Here is the DOS stance about approved visa petition extensions, from the DOS FAQs: https://travel.state.gov/content/travel/en/us-visas/immigrate/family-immigration/nonimmigrant-visa-for-a-fiance-k-1.html

Good luck on your immigration journey.

I emailed the embassy and the response was that the CO will automatically extend at the time of interview. No other paperwork needed. Email them beforehand.

That is from the Montreal consulate?

Jerusalem consulate. I first called the NVC and they said to contact embassy. Many ppl can’t get their interview in that 4 month timeframe. We’ve never received correspondence initiated by the embassy and it takes 2-3 weeks for an email response. They were very nonchalant about it when they responded....probably because it happens so frequently.

You cannot compare Jerusalem's process with that of another consulate as each has their own and may be different

YMMV
