Greeting to the experts in the house please  I want to  ask is it advisable to ask my lawyer to file for I-129f  now I have been waiting for my NOA2 for the 6th month.

Thanks.

I'm not an expert, but I see no harm in submitting it......if you are willing to live with the ever so slight possibility that a K-3 might be approved (extremely unlikely)

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I would submit it.......There is a near zero chance the K-3 would be approved.....

@Plsam, I assume that you are applying for a CR-1 or IR-1 visa? Waiting and patience will possibly be your life for the next 6-8 months. After the visa gets approved by USCIS, it then goes to the National Visa Center (NVC). Somewhere between the NVC and the Consulate interview paperwork is collected for the Adjustment of Status (AOS) so that once your spouse enters the USA they can use their visa as a Green Card (GC) until receiving the actual GC. From there it goes to the Consulate in the country of your spouse and sometimes interviews do not happen right away and you have to wait, depending on the Consulate. Then once your spouses visa is approved at the Consulate stage there is a wait for the visa to come back with your point of entry (POE) paperwork. Hang tight, I know its stressful to wait, just look at my timeline of the waiting I have had to do.

Closer to 8-12 months at most service centers now, actually.

For an immigrant visa, the Affidavit of Support (I-864) is submitted at NVC and reviewed at the interview by the CO.

There is no Adjustment of Status (AOS) for an immigrant visa.

*NOTE: Technically the K-3 is non-immigrant and you can do an I-134 for the visa then AOS later, although the odds of actually getting the K-3 visa are basically lower than winning the lottery - only a few were issued all of this past year. People are filing an I-129F for a K-3 because it may or may not speed up the I-130 adjudication for a CR-1/IR-1 visa based on some others' recent experiences.).
