Bring adopted parent

Timeline

So my fiancé was adopted when she was born. But they haven’t formal filed their paper work until 2016 when she already turned 21. If she becomes us citizen. Can she still bring her adopted mom to the us? Uscis states have to be adopted before 16. But there anyway to show that she was really adopted way before? Like a letter from the biological mother stating she had abandoned her to adopted mom at birth?

Well to immigrate she would need to be a USC and that seems many years off, the legal date is what matters for adoption, informal arrangements do not.

The mere fact that she still has contact with the biological mother would immediately raise questions.

anyway, doesn’t sound like it would work as they need legal paperwork the adoption happened before the child turned 16. See https://www.uscis.gov/family/family-us-citizens/bringing-parents-live-united-states-permanent-residents

Requirements:

petition is filed to bring your adoptive parent to live in the United States,
  • Form I-130
  • A copy of your birth certificate
  • A copy of your Certificate of Naturalization or Citizenship if you were not born in the United States
  • A certified copy of the adoption certificate showing that the adoption took place before your 16th birthday
  • A statement showing the dates and places you have lived together with your parent

 

 

Otherwise anyone could get their bio parent to sign a letter to sponsor whichever adult they retroactively decide adopted them...

Thanks for the info. So according to my fiance, her father went missing in Thailand. They were not able to finalized the adoption without the father signature. She was only able to be adopted after she turned 20 due to father being missing per Thailand's adoption policy. The biological mother has another family and had abandon her after two months of giving birth. She only found out about her biological mother at age 10. If that is the rules I guess there isn't anything she can do.
