Petition for my spouse and child

I am a US Citizen (Citizen Born Abroad)

Born and raise in the Philippines and just recently came to live in the US in 2017.  I am married for 8 years now and have an 8 year old daughter. My husband and daughter are back in the Philippines. In my marriage, my husband and I never really have had joint accounts or assets because he's the only one who was working at that time. Will  that affect he's chances when it comes to proving that our marriage is legitimate? What other documents can I submit in order to prove the legitimacy of our marriage.?

 

Also, I have only worked for 2 years here in the US and doesn't have 3 years of income tax returns. Will that affect my capability to support? My sister is willing to do a joint support. 

Lastly, would you suggest for me to hire a lawyer? will that give me a better chance to get my family approved?

If you were born a US citizen shouldn’t you have a US tax return for the years where you worked in the Philippines? Did you just not make enough income to have to file?

I have only started working when I came here in the US. Only For 2 years that's why I only have 2 years of income tax returns (2017 and 2018)

When you filed taxes did you file as married? 

In the Philippines did you have any joint ownership? Both of your names on accounts? Credit cards? Proof of residing at the same address?

A lawyer doesn’t give you a better chance to get approved. You can find a lot of information here. I would mainly be concerned about financially supporting a family of 3.

THANKS FOR REPLYING. No, I filed as single because that was suggested by the tax person for they don't have SSN or ITIN. So, I filed single.

You are not single.  Start by fixing the taxes and then file the I-130s.

Agree. You were given incorrect information. It doesn’t matter where in the world your spouse is- if you are married you file married.

Is it really? because I went to 2 different tax companies and said the same thing. I will have to file single for tax purposes only because my husband does not have an SSN and ITIN.

Also, my husband don't have any proof that we live together in terms of bills. It was either named to me or named to him. I am his beneficiary in insurance and SALN in the Philippines tho.

Is it possible to just give my certification of employment as proof that I have a full time job and just use my sister's tax return since she's co-sponsoring.

No.  You are required to File a I-864 as you are the primary sponsor for your husband and child.

 

Your taxes should have been filed as married filing separately.

 

Time spent face to face to in PI will offset some of those items you should have had during a marriage of this length.

You might be best to are get an attorney to help you out.  No one here would tell you that filing as single is a legal status for you.

Well if you have been married 8 years evidence should not be an issue.
