Is Planned Parenthood considered a public charge?

Hi all,

 

My wife immigrated from Brazil in 2014 and overstayed a visa. We were able to adjust her status and had the overstay forgiven, and she received her conditional green card in January 2019. She will be eligible to remove the condition in early 2021.

 

Neither of us have health insurance due to working as contractors. She is having some minor reproductive issues and needs to see a gynecologist, so she made an appointment with Planned Parenthood. If she receives low or no-cost care when going to PP, could this be considered a public charge? Is it possible that this may jeopardize the removal of her conditional green card in a year and a half? I'm a little unclear if the public charge rule was ever fully put into effect and if this is even an issue for someone who already has a green card.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

  1. Public charge is not an issue for ROC.
  2. PP is a private organization, not a means-tested benefit.
  3. Contractors can obtain insurance...nothing is preventing you from getting covered.

Please get your wife the care she needs OP, without fear. But I'd further suggest that you both have health insurance in the future. Reproductive health is important for women, and PP provides valuable services - but having insurance would provide further peace of mind if any health issues arise.

I'm an independent contractor and I have health insurance for my whole family, so there is no reason you can't have health insurance. It's REALLY important to have health insurance here (even though it can be borderline unaffordable) because if god-forbid something ever happened, the amount of debt you could accrue is unimaginable. You can start by looking into the Affordable Care Act exchange in your state. You will get a reduction in cost based on your income if you are not receiving a high salary.

I hope you can find adequate health care insurance (which should be a MAJOR consideration for all new immigrants) in case one of you face MAJOR issues in the future.
