When you hire a lawyer to do your AOS and he fills out the bottom of the forms which indicate he prepared them, does USCIS send correspondence and RFEs to him or to us?

I would much rather prefer that all correspondence come directly to us.

PS. Our lawyer's paralegal isn't as diligent as we would like her to be.

Well I only used a lawyer in my H-1B case and She received everything (sometimes was so frustrating). Now in my AOS process I'm without lawyer. I believe that with the VJ help and good internet research you don't need a lawyer but anyway I don't know if you can make any change now, maybe with a AR-11 form? I don't know. You need to talk with your lawyer and request any way to receive the mail directly. I understand your point perfectly because I'm very obsessive to receive my USCIS ASAP and then you need to wait more because your lawyer receive the mail, take her time (with no hurry) and send the mail to you when she likes...

Thanks gustahot. Does anyone know exactly how USCIS determines where to send correspondence and RFEs? I personally would do all the paralegal stuff myself (like form preparation et al.) and then have a lawyer there on an ad hoc basis for any questions or advice.

We've started the process with the lawyer, but haven't filed yet, nor given him his AOS fee. One thing is for certain, there's no one more invested in our AOS than us, and the lawyer and paralegal have show that their due diligence isn't quite up to snuff.

From what I've read on here the lawyer gets all the correspondence. It may be up to you to find out if and when you get an RFE.

The paralegal is what worries me. She's was dismissive in our questions and concerns and is obviously not fully invested in our case as we are. She's become a wee bit careless (spelling errors, inconsistencies, lack of command of the English language :o etc.) and has a no-confidence vote on our part. One good thing is, we haven't filed it yet using the lawyer. So I am at the stage now, considering whether to just do it on our own, or pursue it with him.

We plan to tell him tomorrow that although we have faith in him, his paralegal makes it almost impossible for us to feel at ease. Our first impression of the paralegal is past the point of no return. So we plan to tell him that we will do all the form filing, evidence collection and document preparation, and we will just ask for his counsel on an ad hoc basis.

Any thoughts on the matter?

Our attorney's paralegal sent our K3 to the wrong center, took months to get them to acknowledge the error and correct it. All the correspondence will go to the preparer of the petition. Good luck in your AOS!

We hit some snags trying to remove the lawyer. I waited til Mohammed had his visa and here before filing the lawyer removal papers. Even after sending in the form to USCIS, all the correspondence went to the lawyer. We did the AOS/EAD on our own as he wanted an additional $1500 to do it for us. :blink:

It got worse. He felt I owed him an additional $200 to retreive all my papers and originals of the NOA's. I had already paid $2000 for a misfile and 2 RFE's. :wacko: So if you already have someone on record, make sure they get removed properly.

Oh dear. Certainly wise words from experience, thank you. The lawyer seems reasonable enough, and we are at an early stage of our engagement. We plan to talk to him tomorrow. Thanks again guys (gals) for the responses.

Yes, do on your own. Its not brain surgery to apply for AOS and research things, if you don't have some extra specific case. But you will do it with more care about each detail, then your lawyer.
