Yep. Sure was lol. He entered first and was in the US for a matter of hours and was caught at the border and was sent back within 3 hours. One month later, in 2000, he entered again and never left.

All he can do is be totally honest and disclose the illegal entry he did not disclose on the previous forms submitted for AOS and DS-260, tell them first thing at the interview and hope for the best.  If he does not disclose it and they have it in their records, they will view it very negatively and that could lead to deportation which you want to avoid.  Good luck!

I thought he was still present in the US?  Or are you referring to him needing to go back to Mexico as the whole AOS is adjudicated?

A waiver was approved last month. He will leave the US and do consular processing for the IR-1.
