Filled I-485 in the expiration date of I94

Hi!

 

I need advice about my case :cry:

At first, I thought K-1 Visa expiration date is the date written in visa. However, the actual expiration date is written in I-94.

So , I sent every paperwork & marriage certificate (I married my husband 1 month after entry date) in the expiration date of I-94.

The documents were delivered in the next day. 

 

Do you know what's going to happen to me? Will I be exported? :cry:

I married my fiancé within 90 days

My expiration date: May 9

The date when I sent files to USCIS: May 9

Not sure what you mean here.  Did you marry within the first 90 days of your arrival into the US on the K-1 visa?  If so, you're fine.

Yes I married my fiancé within 90 days of my arrive into US on K-1 Visa.

You have been in illegal stays since the day after your I94 was dated .. but once you receive your NOA for the AOS packet you are then in legal stay until it is adjudicated. You are past the risky time

You're fine. The only actual obligation to fulfill the K-1 requirements is marrying within the 90 days. You did so that's fine.

 

While yes, once the I-94 expires you become out of status/unlawfully present, but once you receive the NOA1 for the I-485 you become back in status/a limbo so to say where you are authorized stay pending the I-485 outcome. Any unlawful days after the i-94 expiration and the NOA1 is ignored/forgiven. A lot of people tend to go over a few days.

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

No. Not because of this. There is no required time limit on applying for AOS. The consequence of not filing before the I94 runs out is no legal status until you do file. You are passed that. You have filed. You will get your NOA soon. Watch for your payment to be cleared  .. if it’s a check

@Lil bearThank you so much for your comment :cry:I worried about it so much. I'm so stupid.. I thought expiration date is the one written in the K-1 Visa (As you know the due date written in K-1 visa longer than the expiration date written in I-94)

You are conflating two different things. 

 

The expiration date of your visa is printed on the visa itself. You must board a plane or enter the US on or before that date. 

 

The expiration date of your legal status is printed on your I-94. You must marry on or before this date to fulfill the requirements of a K-1 visa. As stated above, there is then no deadline to file your I-485 for AoS, but you will be out of status and deportable until you do so.
