Hi all!  Thank you for your encouragement and answers.  Yes, I think that we won't know for sure until we get the YAY or NAY from USCIS regarding accepting what we sent.  They may have called it "insufficient" because of the letter used and maybe it is sufficient.  Because of the overload, it wouldn't surprise me that is more of an error on their part than ours.  After all, is not like Argentina has other birth certificates or anything.  Haha

So true! In my experience for the Embassy interview I had my birth certificate instead of the acta and they told me I would be approved if I was able to send a copy of the acta de nacimiento, because se birth certificate has no legal value under the US law. So I got my approval delayed a week until they received and checked the acta I sent to the Santa Fe building, not the embassy. I did translate and also did the Haya apostille to be able to use it once I arrived to the US.

For AOS I sent a copy of the acta again, and didn't get any RFE so far, I think you will be ok with what you have.

Yes, I have come to the realization that VJ is a great resource and it is always worth asking, but you need to know your case.  For example, our letters were different but Argentina has no other birth certificates, so I don't know what else they could possible want.  I just went ahead and re-sent it, we will see what they say.

Do any of you know how the public charge will affect us now that they can be implemented until a final decision is made? We are so confused.

From what i've read in the past it only affects for those who unfortunately have had to use social help from government such as social programs due to low income.

That’s what I thought. But, I was also asking because of the language thing. However, it seems all of that would be applicable to new and not retroactive. We are going to need a translator, so that’s why I was worried.

I think as long as you can prove you won't become a public charge you should be fine. Agree with @Javier Mera, think they are more concerned about those with low income/high debt who would have no choice but to rely on the government to live. Things like unemployment benefits, food stamps, that kind of thing.

I still don’t have an interview date. Just the ‘ready for interview’ hopefully I’ll get some news soon. USCIS really screw up out case. We got congresswoman and lawyers involved. I’m crossing fingers everything will be over soon

Congratulations! I'm so happy for you after all you've been throughout this process and how USCIS really messed up your case.

Received official confirmation that USCIS will be implementing the public charge rule (I believe is effective February 24th).  I am sharing this here for those that have not yet filed for a K1 visa (the ones to follow), are in the process of it, or will be applying for AOS soon.  Make sure you check the updated forms and how this will affect the stage that you are at.  For those of us that already filed (even AOS), this should not apply to us.  Some dates are sticky it seems that they are also mentioning the October 2019 date as a reference, but I don't know how that applies.  My advice would be that if you filed after the October 2019 initial due date, then you should research further.
