USCIS - NVC extreme delays

Hi guys,

 So our K1 petition got approved 4 months ago but NVC said they still have no record of our documents. We've called USCIS and the NVC multiple times but they keep going back and forth with us. It seems USCIS totally forgot to send our case to the NVC and the Approval Notice expired 2 days ago but NVC has still not received anything. 

Has this happened to anyone before? If yes, how do we go about this situation? Also, how do we get an extension for our expired Notice of Approval which has still not reached the NVC?

 

Please HELP! Any tips would really be appreciated. Thanks.

Timeline

When you call USCIS, have you only spoken to a customer service representative?  If you haven't already, get transferred to Tier 2, which are immigration officers.   They can issue a service request.   You can also do this yourself online but they may be able to give you more info on the spot.

09/2015- Visited Nigeria again!!!
10/28/2015- NOA2 (237 day wait at TSC)

11/27/2015- Arrived at Embassy
06/2016- Third visit to Nigeria!
06/15/2016- Interview, given option to file I-601 waiver.
08/16/2016- Waiver submitted (no lawyer).
11/21/2016- Waiver approved with expedite.
01/2017- Embassy requested interview. 
04/2017- Fourth visit to Nigeria.  K1 officially denied. 
04/25/2017- NOA1 for 2nd K1.
07/27/2017- Case transferred to TSC.
11/17/2017- Case transferred back to CSC.
01/16/2018- NOA2!! (266 day wait)
03/08/2018- Interview (AP)
05/03/2018- VISA APPROVAL!!!
05/14/2018- Visa issued
05/18/2018- Visa picked up
05/25/2018- HE'S HOME!!! 💙💙💙

We got transferred to Tier 2 weeks ago and they informed us that it looks like our files didn't get sent so they're going to ask the California Service Center to send them to the NVC. We called back again today only to find out nothing got sent and the wait time for tier 2 was 580 mins so we'd call back tomorrow to find out more information on what's going on.

Contact one of your congressional representatives to sort this out for you. They are paid to bat for you on things such as this.

You might try both options below.

 

First try submitting an inquiry using this link from the Ombudsman; submit your request online.  If you have already submitted online but did not receive a confirmation email with your case number, the submission did not go through.  Please try again. 

 

If you have not submitted Form DHS-7001, Case Assistance Form, online or made other arrangements with our office to file on paper, we will not respond to any emails.

Update: We called tier 2 today and officer said all he can see is that our documents are in transit to the NVC. However, he cannot tell exactly when it got sent and couldn’t give us any time frame to hear from the NVC. Smh

Well, at least it's an improvement. Start calling NVC for your case on Monday?

So NVC finally received our case 2 weeks ago, and emailed they're sending it to the US embassy here. However, our I-797 expired # weeks ago, and I was how we can get an extension. Any suggestions would be appreciated.

Contact the Embassy. I believe they have the power to extended it. It is also possible USCIS automatically extended it.
