My brother-in-law just had is interview on 4/16/2019 in Yerevan Armenia. He is a Iranian National under F2A (child of LPR). After his interview the consular gave him a form indicating that he is being considered for a waiver, but nothing else. However, as of 4/18/2019 NVC Case Status check (https://ceac.state.gov/CEACStatTracker/Status.aspx) shows up as "REFUSED". Will this be updated at a later time?

 

Anyone in the same situation? I would think it should say "Administrative Processing"

Not AP....It's a travel ban restriction, I believe.......

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

This does not make sense to me. Based on the Travel Ban's community form all people that have been classified as eligible for a waiver have been placed on AP. Our case the form clearly states that we are eligible for a waiver, but to approve the waiver the consular must determine that denying would cause undue hardship, no threat to USA, and of national interest.

 

My questions stems from the case status check that says "refused". Because how could they have complete a full review within 2 days of the interview when everyone else is waiting over a year. So is this just the standard or should it be in ap. From a non-travel ban case I saw someone mention that they place  their status as refused and within a week or two change it to AP.

"Refused" is not necessarily a final decision......In 2017, after my wife's interview, she was given a 221g for additional documents......the status immediately changed to REFUSED.......Once the consulate reviewed the documents, it changed to ISSUED.........after review by the consular, it could change to AP.

Thank you for your fast reply. I was assuming refused meant denial. Only weird part about it is he did not get a 221g from the consular.

 

With prior case I have completed for my father-in-law he was placed on AP (this was before the travel ban back in 2016), but the consular status this during the interview.

Yes it will. You'll get an email to send in DS 5535. Once you send it within 2 weeks it should change to Administrative Processing. And it will stay that way for what will seem like an eternity :-(. Welcome to the club.

I see that @salhasl answered your question. I remember how my heart dropped when I saw "refused" after my husband had his interview. 

 

I wanted to recommend- if you have not already that you follow the "travel ban support group" page- there are lots of us in that "club" unfortunately. There is also a page for DS-5535- but not all of those people are going through the travel ban.
