Hey everyone!

I hope someone out there is able to reassure me... My husband and I filed for my I-485 Adjustment of Status on March 25th with FedEx, to the Chicago Lockbox facility, and based on the FedEx tracking number, it arrived there on March 27th.

It's been 3 weeks now but I haven't heard a word from them! I should also mention that I included a G-1145 for email notifications in my petition, and I filed for AP and EAD at the same time, all in this package.

Looking at average times of how long it takes people to get Notice of Action 1, I wonder if I'm way past the normal timeline here. They haven't withdrawn the fee from my husband's bank account yet either.

 

Is there anything I can do? USCIS wants my receipt number to check on my case status, but I didn't get a receipt number yet since I don't have NOA1.

It sounds like they haven't gotten to your application yet. Agree with payxibka...follow the money.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

NOA1 should have been received a week or less after the AOS. You should be very concerned. I've no advice to offer. I read enough of these horror stories on visajourney to conclude that AOS, EAD, AP, and removal of conditions were well beyond my capabilities to handle and so I hired my K-1 wife a lawyer. Every NOA, RFE, etc the lawyer gets, we get.

 

We had a scare last week with the lawyer getting the I-797 for biometrics and USPS Informed Delivery telling us USCIS send us a letter around the same time. The letter did not arrive on the expected day, and we went to the post office a day later to complain. It arrived later that day.

 

The peace of mind of an immigration attorney is well worth it to me.

?? Not really... And you’re pretty lucky with the lawyer cause most lawyers mess up, especially k1. Immigration attorney can’t do anything for this situation.

it depends on the time of the year, any possible holidays etc too..

For AOS it can actually take longer than most other petitions.

i have sent my case August 27 - reached there August 29 and didn’t receive anything till September 11. (Also my check wasn’t cleared even at the time I received noa1 in mail- I believe it cleared around the time my biometrics was scheduled) 

 

did you check March filers who filed around same time or later are also waiting? What’s the average right now? 

 

If it arrived there and theres no move in total of 4 weeks, I’d suggest calling uscis (which probably won’t do much) and calling usps to check the status again(which again probably won’t do much).

 

 

There’s always possibility they got your email wrong and it will come in mail. Although it is worrisome I know, I’d wait till it hits a month, then start asking around or just redo your AOS and send a new one.

I’m lucky only if I don’t do any due diligence on the reputation of the lawyer.

Thank you for the advice! Luckily we didn't have to wait quite 4 weeks. This morning we finally got something in the mail. It was an RFE, because as it turns out we made a mistake with the payment amount, but we can fix that and send it back.

Thank you to all posters who responded, and for anyone else who experiences a similar situation, don't panic if it takes a few weeks!
