K1 Fiance' Not Stay

That led to a discussion about what to do about her passport.  She wants to get a new one.  However, I don't really see a need to get a new one in her new last name.

To travel, she just uses the name that is in the passport.

What I am unsure of is when our case gets to NVC and Embassy, would it be easier to have a passport in her new last name, or will the old passport suffice.

She still has many years before her present passport expires.

 

What about using her passport as an ID for when she first gets here..any issues with last name in passport being different than her wedded name?

When you get married your wife's married name will be;  GIVEN NAME, PREVIOUS SURNAME is now middle name, HUSBAND'S SURNAME is now her surname.

 

You will want to complete the I-130 in her married name so that her green card will be in her married name, thus she will need her passport in her married name.  If your wife does not get her passport in her married name you will have to file the I-130 in her maiden name, and her green card will be in her maiden name as well .... but the marriage certificate will be in her married name.

 

K.I.S.S.     New passport in married name.   (she will attend CFO to get this done so that will be handled  ;)  )

Does she need have her new passport before I file I130?

I see a place for her passport number and expiration date.

I know the expiration date will change with new passport.

Is it ok to use her old passport information here?

 

Or should I just wait until she has new passport to file I130?

Beneficiary Entry Information  is for IF she is already in the States.   So you check box #45= NO and move on.      No passport necessary for filing the I-130

Fill out the I-130 with the old  (current) info.    Get the new passport while waiting and then either use it at the DS-260 stage or at the interview.    

 

Last July after I filed our I-130 Mary went to Mexico City Embassy to get the NBI clearance and new passport.  We actually got the passport back before the NBI slip.  We updated at the interview.   Very easy!

April 30, 2018  Mary moves from the Philippines to Mexico, Husband has MX Permanent Residency

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Researching marriage in PH seems to be at least a 2 trip affair as there are multiple waiting periods of 10+ days.

I didn't read the whole thread, but.....

Personally I see a problem with marrying someone in the Philippines, specially for a different visa process. The K-1 is the best route to go, the circumstances you described for a second application seems to be one of the most legitimate.

 

If you marry someone in the Philippines and anything goes wrong, then there's a problem that is a real headache to fix (unless you can easily throw gobs of money at it and don't mind)(P250,000, 3 years, I gave up and came home for divorce).

No divorce in the Philippines, and even if you divorce her in the U.S., if she is in the Philippines, the divorce will not be recognized by the Philippines government unless she goes to court and proves the divorce is valid. This will cause hardship and possibly trap her.

To update this story/thread..

To marry in the Philippines required 2 trips.

First trip..US Consulate visit, CENOMAR for both, engagement, 4 hr church marriage counseling, 8 hr govt. pre-marriage seminar, application for marriage license.

That took a full work week.

 

3 weeks later..

Second trip..Wedding, honeymoon...That took a full work week.  😛

 

Took 2 weeks to get PSA copy of Marriage Certificate.

Added wife to Medical Insurance.

 

Submitted I130/a on July 23, 2019.

USCIS received on July 25, 2019.

Got an IOE receipt at Potomac SC in VA.
