There is no discretion in that circumstance. The policy manual is clear in that someone on probation, parole, or under a suspended sentence cannot be approved.

I know that there's no discretion regarding parole/probation when approving the N400 application....it was my understanding that the OP was asking about the oath ceremony, and the citation happened after the N400 approval.   Is there no discretion when it comes to taking the oath while on probation with an already approved N400, or the policy is in place only in regards to the initial approval beforehand, and the oath is at the discretion of USCIS then?  I'm trying to find it under the manual in regards to the oath being refused by policy with no discretion whatsoever.

 

Then again, I suppose technically the approval of the N400 is also contingent on a successful oath ceremony happening afterwards, since one doesn't legally become a citizen until then.  Hopefully the OP won't get any probation as an end result/have an open court case.

Since you need to maintain eligibility throughout the entire process (application -> interview -> oath) it's my understanding that it doesn't matter whether the N-400 is already approved or not. That's why the oath ceremony questionnaire exists, to check whether you've done anything that renders you ineligible to naturalise on that day.

I would not wait posting question here and waiting for replies. This matter should be discussed with an experienced immigration attorney. Hope everything goes on well and you don't get back to Udta Punjab.
