NOIR Response Time

Hello.

 

Long story short:

visa interview Jan 30th 2018 ... resulted in a 221(g) and AP.

2nd March 2018 ... AP completed. File Returned to NVC

27th May 2018 ... file received by USCIS.

With the aid of Congressman Ted Lieu's office, USCIS examines file around Feb 22nd 2019.

Feb 29th 2019 .. NOIR issued.

 

Immediately engaged attorney. $3k and a lot of paperwork later, we have a response prepared and likely sent yesterday to USCIS refuting all responses. My attorney claimed the letter was "cut n paste" similar to other NOIR's he's dealt with lately.

 

My question is this: leaving aside the substance of the NOIR letter ... how long is TSC taking to process responses? I've read of responses in as little as a week or as much as six months. I've also read they aim to process within 120 days of response. Love to know if there's any average timescale on this obviously depending on complexity of the NOIR.

Therein lies the issue. How long it takes to respond is highly dependent on what they are responding to. Some items may be easy/quick to verify and reaffirm or deny. Others might require more investigation, validation of documents, etc.

Hi there, how is your NOIR response going? My husband received NOIR in Sept 2018 and our attorney responded within 30 days. Our response has been received for over 5 months and still no updates. This is such a long wait!

Ours was reaffirmed in under two weeks (about 10 days) from them receiving my rebuttal but to be honest it's the fastest I have seen.   Many wait 6 months or more.  I did not use an attorney as mine was pretty simple (some of it was also cut and paste).

NOIR was registered as received on Feb 28th. Not quite a month in at time of posting.

We sent our response to NOIR and the TSC received it on March 11, 2019.  Waiting..

Apologies for bring back a really old thread but my NOIR was processed and my application re-affirmed in 159 days (aka this morning of posting) with one congressional inquiry.

My NOIR case received on March 15 and still waiting for response. I transferred to other employer and i am working on receipt . If my H1b is revoked, does that impact my current h1 transfer too ? Any idea?
