Hello JC and Amoro,

I am routing for you guys. I have been with the officers on the phone who say different things through the last 8 months. In the end, it is what this adjudicator does to the case on the desk. As deb said, there is no logic to this madness..Hope you guys get approved ASAP...

My wife went today to the consulate and got packet 3 & 4. Our interview date is set for the 8th of April. Now to just get ready and make sure that I collect all the needed materials. Hoping that all get their approvals very soon, and goodluck to thos who are about to be interviewed. And long life and prosperity to those who are already with their SO's

Congratulations on your interview date!!!! Unfortunately, I am still waiting for my petition to make it to the NVC even though our petitions have been approved since Jan. 9. I just got off the phone with NVC and they said that it is not there as of yet. I also called USCIS and she checked to see if it was still in their mailroom, but she swore that it had been mailed out Jan. 9. She said that NVC accepts thousands of applications every day and it takes them time to get the information into their computer. There are times I feel like crying cuz it doesn't seem that I will ever get away from the clutches of USCIS, but I have to keep trusting in God.

Tell your wife good luck for me.

Deb

I am so sorry to hear about your plight Deb. it does not make any sense that you were approved so long ago and yet to get to NVC. Both Ose-n-me and I got approved on the 15th jan and we have our petitions there now. I really feel your angst, just continue to call and bug NVC. Your stuff has to be there somewhere. I will extend your regards and have you in my prayers too.

I would like to ask you a question. When you called NVC, what number did you give them? The WAC # for your I-129F? I just want to know that I am giving them the right thing.

Thanks for your help,

Deb

I gave them the MSC#. Not the I 130, but rather the I 129 K3 number. Hope they see it soon. I know how frustarting this can be.

What is an MSC#? I understand from calling USCIS this afternoon that USCIS keeps the I-130 until my husband comes into the USA on his K3 and then he has his interview here in the states. I have been giving the WAC# from my I-129F, but I still don't know what the MSC# is that you mention. Where do I find that number?

Thanks,

Deb

Receipt Number: MSCXXXXXXXXX

Application Type: I129F, PETITION FOR FIANCE(E)

Current Status: Approval notice sent.

On January 15, 2008, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service.[/size]

This is the K3 number I gave, the one below is the i130 that stays back with CSC. Hope this helps.

Receipt Number: WACXXXXXXXXX

Application Type: I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

Current Status: Approval notice sent.

Clearly chinemeze filed his I129F at Chicago and it was forwarded to Missouri where they assigned it an MSC number then it was forwarded to CSC to meet up with his I130 which was assigned a WAC number.

My I129F was sent to Chicago where it was forwarded to Missouri and assigned an MSC number then it was sent to Vermont to meet up with my I130 which was assigned an EAC number.

What chinemeze is saying, use the number on the website or your NOA from your I129F. In your case that number is either an MSC (assigned by Missouri) or a WAC (assigned by CSC).

Hello, Amoro,

As Deb said, it's hard (if not impossible) to understand what USCIS really meant; if indeed what the officer told me will actually happen; or if my case and your case will have the same treatment.

Let me give you more details on how my conversation went with the officer. First thing she asked me was if I paid anything for my I-129F. I sent it in August, so the answer is no, I did not paid anything for my I-129F. Then the officer answered "your I-129F is going through an administrative cancellation. When I-130s were taking too long to get processed, I-129Fs made sense, but now since our times have improved (yeah, right), why would you want to have a K3 when you can have the I-130 approved? Your I-130 is in the queue for approval, may happen tomorrow, the day after, blah blah".

I was left with the impression that if I had paid for my I-129F, it would get processed. But since I didn't pay for it, my only option is to wait for the I-130. Go figure. Yesterday, after discussing this with my wife, I came to the conclussion that I could spend nights and nights trying to make sense of this whole process, and still be left with more questions than answers. So I will simply wait, Amoro. Wait for an RFE (I haven't got one yet), wait for I-130 approval, or maybe even I-129F approval. I will call USCIS around Feb 15th, if nothing happens before.

Please let me know if your case changes. Your case has been the closest to mine that I've found. Good luck, my friend.

Juan, that's exactly what they said to me in November. I was told by the person on the phone and their supervisor the same thing. They said it's their "policy" to terminate the I129F and I didn't really "need" it. They said i'd be better off in the long run but they didnt take into consideration that it takes a lot longer to get an interview for a CR1 then for a K3 so I was crushed.

I asked my senators to try to stop them from terminating it. They couldn't do anything.

I called them repeatedly only to be told the same thing over and over again. So i pursued the CR1. I made ALL the payments.. grand total $830. I now have one final set of documents to send them to complete the CR1 at the NVC and suddenly on 1/24 (after 4 months of inactivity.. 7 months after filing) my I129F was suddenly approved. Their "policies" are not policies. Their rules are only rules to some.

My advice, pursue the CR1 just in case they actually do terminate your I129F then you won't kick yourself later for wasting time but don't forget about that K3. The adjudicators clearly aren't let in on the policies of the USCIS and it might just be approved. Mine was not the only one that got approved suddenly.. asmo and davejaz had the same thing happen. Asmo and Davejaz were smart enough to pursue the CR1 from the beginning.. i didn't. I held out hope for that K3. In the end I got lucky. We may not all be so lucky.

Some might call it "smart". I call it "lucky". But Jaz and I will graciously accept the compliment Kathryn, Thanks! :D Our K3 petition made it to USEM and CR1 is still pending at NVC on an RFE (those bastards) :P I am grateful for the interview but I hoping NVC schedules the CR1 interview in the same month. (I would much rather Jazzie come here as a (pardon the oxy-moron) "conditional" permanent resident) At least its something though, I just want her here...bottom line.
