Process to withdraw a denied K1 Visa?

Hi,

 

I wanted (and still want) to bring over my fiancee from Vietnam but our K1 Visa petition was denied at the consular level in early January 2019 (took a freaking year and a half).

 

I was reading on this forum about the possiblity of withdrawing the K1 visa.  My question is how do I go about doing that?  And what are the benefits of withdrawing a petition?

 

I am thinking about reapplying for a K1 visa for my fiancee or possibly marrying her and applying for a spousal visa.

If it's denied, you can't technically withdraw it. It'll just expire. Get married and do CR1. K1 Part 2 will be a waste of resources.

Nothing to withdraw.  Fix the reasons for the denial and get married.  If there is an issue with the spousal visa you can appeal it.   Can't appeal a K1

You can't withdraw it if it's denied. What were the reasons the visa was denied?. Knowing why,will help you in your future application for the spousal visa.

I think the OP wants to withdraw the I-129F petition. The K-1 visa was refused already.

You can just submit a letter to USCIS requesting to withdraw the petition. If you marry & file an I-130 for your spouse, you can include the letter with that packet as well.

 

Before going that route..do you know why the K-1 was refused? Lack of a bona fide relationship?
