Bringing a Parent to the US

I’m in the process of putting things together so I can bring my mother to the US. My husband and I have joint tax returns how would that work in on affidavit of support form. Please Help!

As the petitioner you would sign a completed I-864 and your husband as your household member would sign a completed I-864a

Unless your income alone is qualified then you just need to file the I-864 EZ and no need to involve your spouse. I did that for my mom. I made enough money to qualify to sponsor my mom. If you file tax jointly, the only thing extra you'll need is W2 to prove that your income alone is enough. No need for anything from your husband. You don't need any of that stuff until after your I-130 is approved anyway. So first step is to file your I-130 to sponsor your mom. The only document you need with that is your birth certificate.

This meets meets mandatory requirements for an I-864.

It's not uncommon for a CO to require an I-864A from the spouse if they file jointly. They may or may not request this. NVC likely will not care.

They didn't ask me that. I attended the interview with my mom. They only looked at my most recent W2 and ask no question about that.

Definitely possible (as you experienced). Others have been asked for it with the same circumstance.

My mom and I attended the interview together. We waited in lines for 3 hours, 3 looooonggg hours in various lines outside and inside the US Consulate. It was HOT, it was HUMID like 200% humidity. There was no AC in the waiting area. There was AC in the areas the CO were working though. How nice of them. I must tell you, I am a big guy, 220 lbs, 6ft4. It was torture.

 

And then it was the interview.

 

They asked my mom a grand total of two questions:

 

1) How did your son get to go to the US in the first place?

2) What is your son's marital status?

 

It took a grand total of 30 seconds

 

Then "Congratulations, your visa was approved. Welcome to the United States of America"
