Does anyone have any past issues with the border coming in on Advance Parole? Is there a chance you could be denied admission, obviously there is but is it really high? lets say everything is filed by the books and there is no issues with lawful status prior to departure and not a refuge/asylum. My husband wants to visit his home country 6 M from now but not sure when all will be ok to leave and if we will have GC or not. We filed I485  from K1 visa, work permit and advance parole forms and were received 12/20. Any idea for when we expect to fully complete AOS if all goes as expected in Indianapolis? Thanks VJ members!

If he has a valid advance parole document, he will probably have no issues re-entering the US.  After all, that is the purpose of the document.....

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Unless there is a valid reason to be denied (criminal activities abroad, trying to smuggle something in upon entry, etc.), he should be fine. The other "risk" is if AOS is denied while abroad, since AP is linked to the pending AOS application.

Nobody is guaranteed re-entry except USCs, but many people use AP just fine every day.

You said the risk is if he gets his AOS denied while abroad, then he would have problems. So could this be the case, even if he hasn’t had an interview, can they deny him without that? Thanks.

Yes. The most likely event would be not responding to an RFE or not attending the interview.
