Hello,

I am looking to start my AOS for my wife, We just got married on the k1. My big question is on the requirement of the last three years of tax transcripts. I have 2017s transcript but in both 2016 and 2015 i was on a church service mission and made no money. Is it okay to put on the Affidavit of Support that my income in 2016 and 2015 was zero? 

Also i have obviously not filed my 2018 taxes yet. Will they require that tax transcript as well during the interview or just the original one i submitted?

The requirement is to state how much you made in the last three years and send out the last year’s tax returns. If you haven’t made money, you will state so (add an explanation as to why, to be thorough and safe)

 

if if you are interviewed after the new tax season, it’s possible they will want to see the new one. Best to be prepared when the time comes

Hello,

 

Just wanted to check as my situation is similar:

 

1. My partner was a student up until March 2017. Therefore we only have two years worth of W2's and tax forms (2017, 2018). Will this be enough as it includes the most recent tax year? He is in continuous/full time permanent employment that is 125% + the poverty guideline. 

 

What is other peoples experience?

K1 Visa NOA1:  March 2018

K1 Visa NOA2: Sept 2018 

K1 Approved: Nov 2018 (184 days/6 months since NOA1) 

 

Married 4th Jan 2019 

 

AOS NOA1: 4th Feb 2019

Biometrics: 25th Feb 2019

AOS interview: Oct 2019 (261 days from NOA1)

 

EAD/AP NOA1: Feb 2019 

EAD/AP Approved/Rc'd: Aug 2019 (196 days since NOA1)

I am pretty sure with the last year and continuous employment should be just fine. I can't seem to find any part on the i-864 instructions that state about the last 3 years. I might be wrong.

Hi There, got a question. I have taxes for 2018 & 2017, but have no income for 2016, would that be a problem when providing 3 recent years of income in i864? I have the current employment letters, bank statement to prove the income is enough to support my spouse. Appreciate the help and response. Regards!

Hello, for k1 visa, my fiancee (the petitioner) is unable to get her transcript online as she doesnt know what address the irs hold for her most recent tax return (issues with prev employer not updating her address).  She requested one by post but it says its been posted to her address on her recent tax return - she doesnt live there (previous address) anymore.  My question is, how can she get her tax returns sent to her current address? Its for the i134 affidavit of support.

Call IRS and request that they send them to your new address.
