I-130: Choosing US Embassy outside Beneficiary's last residence

Hi again all.

 

I'm referencing: Page 8  Part 60.a-c on the I-130

Question: Does anyone have any advise or horror stories on having a different US Embassy outside the Beneficiary's last physical address?

 

Situation:

My spouse and I are almost about to submit the I-130, but also in the process of moving countries and traveling for 5 months. We are debating on waiting to submit until we start traveling (1 month from now) to avoid the difference in country's since our end country will be Australia where he is from and will want to have his interview. If we wait, the problem is if we state his physical address is Australia (it's currently not true) since he will be "addressless" while traveling.

 

I see 2 Options:

1. Apply now with current address and explain the situation

2. Wait to apply until we leave this country and put his physical address as Australia even though he won't be residing there because he will be traveling the world with no address for 5 months and will go there after the travels.

You only can have the interview at the country where you legally reside, not just visitor.

@H&T So he will be moving back to Australia after our travels (where he is a citizen) and will reside (not just visit).

 

Does that make sense?

If so, yes you can file i130 and have interview at Australia.

Or country of Citizenship.

A person's physical address need not be where they sleep.  If you are "traveling" it's fine to use whatever you consider your "permanent address" to be, even if that's a family member's address etc.
