Child Support as income?

Does anyone know if I can count the child support payments I receive as income on the affidavit of support?? It would mean the difference in my having to use a co-sponsor or not.

Yes I counted my child support. It was accepted by USCIS and NVC. NOW!! On the day of interview, they asked my hubby to bring a joint sponsor. It delayed our process as we were given 221(g) requesting additional joint sponsor. I STRONGLY advise you to have a joint sponsor now instead of waiting at the last minute to find one at the interview. I wish I would have known during our 15 months waiting period. ☹️👎

Yes, it can definitely be counted. The challenge can be in showing evidence that you are actually receiving it. If you have been receiving it, be sure to show a sufficient history of it actually being provided.

 

USCIS doesn't look at the I-864 or any financial support evidence for cases going through consular processing. They do for AOS, though.

NVC only packages and prepares the documents for the embassy/consulate. Their review is very basic on the bare minimums. The CO makes the final call.

If your circumstances warrant it, having a joint sponsor's I-864 at the interview to present (only if needed!) is not a bad idea.

Yes document it with court orders and showing it coming into your bank account. I would not think London would deny a K1 I-134 on that (like the experience from Chile). They are pretty laid back in London...accept 100%, a sponsor other than the fiancé, self sponsoring by the beneficiary with a good amount of savings.
