Eligible for ESTA?

Hi everyone, 

I've tried searching about this but can't find much. So my cousin's husband is a registered sex offender but the family want to travel to the US for a holiday. Is it likely that he will be able to travel on an ESTA or should he apply for a B2 visa?

Nope - here is the link to the guidelines https://uk.usembassy.gov/visas/visa-waiver-program/non-immigrant-visa-waiver-program-vwp/ requirements are the same in all vwp countries but went with uk based on your profile. If he does decide to apply for an esta he has to answer honestly about any arrests. 

 

I wouldn’t be hopeful about a B2 visa either though, if he has the cash to try then go ahead. It would depend upon the totality of his case but the US is pretty harsh on certain convictions.

B2, VWP is for the squeaky clean.Seems a long shot but no harm trying.

He is unlikely to get ESTA.  Apply and see what happens.  Nothing to lose.  If he doesn't get it, he will have to apply for a B-2 visa.  

It's unlikely that a sex offender will qualify for ESTA or a visitor visa.  Some crimes are pretty much a lifetime bar for visiting the US.

Except he's out $160 non refundable B2 fee which might not be appealing to him.

I thought that, I'll just tell them not to bother. I doubt he would want to tell the CO what happened seeing as he's embarrassed by it. He didn't have to go to prison but did have to register on the list.

Agree. So many holidays and family memories there that we provided a bench overlooking the harbour marked in memory of my father.
