CR1 vs K1

I’m still new to VJ community but what I’ve come to realize is that K1 has higher chance of REF’s and NOID’s... The recent posts relating to REF’s and NOID’s are mostly related to K1 applicants... Why is that..? 👀

you need to submit more initial evidence for a k1. people are stupid and dont include everything.

 

most consulates a CR1 is pretty easy (aside from high fraud countries where you do see more 221Gs and NOIDs)

 

i 485, 130, EAD and AP

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

I believe, and it is speculation that if you get a RFE and NOIDS with K1 there are several reason from.

 

1. people do not include the letters with intent to marry, they simply forget

2. They do not read that they have to meet 2 years prior to filing of the K1

3. if approved at USCIS level and get to CO for interview they have included pictures that make them appear too married for a K1 and not married enough for a CR1

4. in high fraud countries there is not enough meetings to say that it is a legitimate relationship.

5. those applying for K1 are too excited and do not fully read all the requirements.

 

really there is such a wide range that there is no real answer.

 

CR1 and IR1 are a little and I say a little easier, yet you still have to do a lot of proof to show that your relationship is on going.

 

any visa category can get 221G or NOID and NOIR...its all about perception when it gets to the CO.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

So you think K1 don’t take this visa process seriously? 

 

I mean, I had to double, triple check before submitting everything and all the informations are online?

From what I have been reading, these two are the most likely reasons why K1 gets REF’s and NOID’s.... So sad...

its not sad. it was due to their own carelessness.

 

plenty of sad things on here, but getting an RFE or NOID because you can't read and follow instructions? nope, can't dole out my sympathy for that.
