From what I understand, spouses of the US citizens are not required to have another biometric service appointment,  unless based on each applicant's case, the USCIS has a doubt on the applicant identity or criminal records and decides that the applicant must submit biometric information for more background check. 

 

I saw many applicants getting their i751 approved without getting another biometric appointment. (Applicants doing the combo i751 and N400 would receive their biometric appointment from the N400). Some even inquired to be refunded based on the instructions, but the USCIS did NOT. 

 

However, I noticed all i751 applicants include their biometric fees when they submit their Application, even if the instructions don't recommend it. If they don't include it, the uscis will reject their application and request that the applicant provide all the fees, even if the instructions don't recommend doing that. 

And it's weird that the USCIS don't refund or return these biometric fees or recall to stop the applicants to submit them. It's really confusing and arbitrary!!! The USCIS don't always follow their own rules when it comes to money. 

 

So I hope it will help those who are worried about biometric service appointment. However, if you have included dependents in your application, that's completely different. These instructions only apply to the spouses not other applicants.

It says it on page 2 of the USCIS instructions for I-751 filing, however I think it has been confused; here is it says:

 

Biometric Services Fee.

  1. Conditional Resident. Each conditional resident and conditional resident dependent included in the principal petitioner’s Form I-751 is required to submit a biometric services fee with this petition, in addition to the required filing fee. (See the What Is the Filing Fee section of these Instructions.)

  2. U.S. Citizen or Lawful Permanent Resident Spouse. If you are the U.S. citizen or lawful permanent resident spouse, you do not need to include a biometric services fee at the time this petition is submitted. If USCIS later notifies you that you must submit your biometrics, you will receive a biometric services appointment notice with instructions on how to submit the additional fee.

 

When it states 'lawful permanent resident spouse', it means the lawful permanent resident spouse of the conditional resident. e.g. the person through which you obtained a conditional residency. So if I (the conditional resident) were married to a U.S. citizen OR a lawful permanent resident then THEY do not have to submit a biometric fee. Does this make sense?

 

So to clarify YES the conditional resident absolutely MUST include the biometric fee.

It says that in the instructions of the I751 page 2.

We called the USCIS and talk to someone about it and he said: "it's exactly as the instructions say " but he was confused too because spouses of us citizens are also conditional residents.  And the conditional residents include biometric when the spouses of us citizens don't include it. 

So who are these spouses of us citizens? 

We are still making research on it to have the uscis clarify this confusion. 

 

However so far all applications have been including the biometric fees and it has been noticed that not all of them received a biometric appointment but got approved. 

 

The best explanation would be the backlog. If the spouses of us citizens don't include their biometric when submitting their application, it's more work for uscis to sent a RFE for fees to whom have to go to a biometric appointment AND then send another Notice for appointment. They are already really slow sending NoA1. So it makes more sense to put everybody in the same basket at first and select the biometric candidates from that basket. For those who don't get picked for biometric,  it's a wasted $85???

It is worded badly, but it isn't referring to the conditional resident who DOES have to submit for biometrics.

Let's hope that's not the case as USCIS considers failure to appear for biometrics appointment as an abandonment to your petition. I strongly suggest you call USCIS as early as you can tomorrow and try to talk to a higher tier (Tier 2 or 3) officer to hammer out the details.

How could these us citizen people or Spouse could or not submitted biometric fees ? Why, how? 

I'm a us citizen,  and I don't see my connection whatsoever with the i751 if not to be at the interview when I'm needed.

I don't think it's worded badly. Each applicant gives to it their own interpretation. And I don't think it's really matter so much how we should understand it.The result is the same: all applicants concerned by the i751 (can not be U.S. citizens) always include their biometric fee. That's what matter more.  There is not even a debate about it.

 

But we are just really curious so we'll keep digging with the USCIS.  The people who wrote these instructions had an idea but didn't make it very clear obviously! Even a tier 1 representative wasn't able to give us an explanation over the phone.

Hi, everyone. I sent my I-751 application through usps priority mail on 10/29/18, was delivered on 11/2/18, cash drawn 11/6/18. I forgot to submit the form to get email and text recipt. Called uscis today and i got my receipt number, its vermont service center.  Waiting for my notice of action in the mail probably by next week. My green card expired on 11/16/18 already. If i dont get it by then will make an appointment to have my passport stamped at local uscis office.

I see there being a clear connection as you file the I-751 jointly as a married couple unless you are separated.

My argument is that it should not be open to interpretation and that it really does matter how the instructions are understood as this could lead somebody to not include the biometric fee, (thinking that they may not be necessary and can save themselves $85) and cause either severe delay in an already lengthy process, or denial; hence why I've felt the need to clarify.

 

I just want to point out this is not a personal, I just want to make sure the correct info is out there. :) 

I'm curious to know, what stage you (or your spouse, as you stated you are a U.S. Citizen) are at in your process I see you don't have a timeline on here?

Hello,

 

I have been reading VJ posts for a long time and finally decided to join...:-)) 

I am very new here so please dont blame me for some "future errors" which I may make.

Here is some of my info: I did send ROC- I 751 w fees - yes, my attorney told me to send 2 checks - 1check as I 751 pettition filling fee ( $595 ) and 1 for Biometrics fee ( $85 ) via USPS to Phoenix, AZ  on October 12th, 2018.

October 19th, 2018 Received the txt message from USCIS that my case was received. LIN #XXXXXXXXXX and the notice ( form I-797 ) will follow in mail.

Same day - October 19th, 2018 both checks were cashed. The copies of the checks are not visible on my bank web site since USCIS cashed them electronically, so I cannot verify the LIN number.

November 13th, 2018 Ive signed up for DHS web site to see any progress. I have two messages there: 1) case was received on Oct. 18th and the NOA will follow in mail. 2) Fingerprint Fee was received on Oct. 18th, 2018 and notice was mailed to me. 

My GC is still valid for next few weeks. So I will not call USCIS even the message on dhs site said " if you will not receive NOA till November 19th,2018 please call us at......

My argument is that it should not be open to interpretation and that it really does matter how the instructions are understood as this could lead somebody to not include the biometric fee, (thinking that they may not be necessary and can save themselves $85) and cause either severe delay in an already lengthy process, or denial; hence why I've felt the need to clarify.

 

I just want to point out this is not a personal, I just want to make sure the correct info is out there. :) 

I'm curious to know, what stage you (or your spouse, as you stated you are a U.S. Citizen) are at in your process I see you don't have a timeline on here?

I still don't see the connection regarding the biometric fees....filing jointly or not. Never heard that a us citizen has been to a biometric appointment for an alien Spouse application.
