Our i-130 application came under study on September 1, 2018
My husband is American and I am Canadian. We want to know if in the 2019 tax statement, he can include me even
if I do not have an insurance number. Also if he can include me in his private health insurance or not.

Whether you can be included in his health insurance would be a question to ask the insurance company.  There is a procedure for filing taxes with a non-resident alien spouse.  https://www.irs.gov/individuals/international-taxpayers/nonresident-alien-figuring-your-tax

Facts are cheap...knowing how to use them is precious...
Understanding the big picture is priceless. Anonymous

I appreciated your answer and information about it.  Thanks!

  • He can include you in 2018 tax year (and of course 2019 tax year). While he files his tax return in 2019 (before April 15 I assume),  he must send his tax file by mail including your passport or some certificate of authentic copy to obtain your  ITIN (Form W-7).  Good news: government allows a very good deduction for jointly-married for 2018 tax year!
  • On the insurance, probably: no. He should ask his employer's HR if he gets his insurance from employment.  My HR said that once my wife got her SSN# , they would add my wife. Otherwise, no.  Anyway, adding additional one to insurance policy costs money so I there is no point to add you if you are not in US.

This is what my husband and I did. I am Canadian, he's American. We filed in April and the tax return was much bigger than if he had filed single.

What bigger?  His refund or his tax due? Just curious because it is very rare that filing  as single is better than filing as jointly-marriage.  I handle all of my family individual incomes and business taxes so I have good experience with tax.

Okay, well then the return was bigger having filed married jointly than if he had filled the other ways. I didn't know the proper lingo.
