Hi good afternoon everyone, ok this is going to be a loooong post... so I’m an US citizen but I’ve lived in Mexico since I was 4, I love Mexico with all my heart and until now living in any other place was out of the question my husband, my 1 year old baby, my mom almost everyone important for me is here but the violence that we are living here in Cancun is up to the roof and we are not willing to submit our baby to this kind of life, that’s why my husband and I decided that the best route for us is the United States my little brother and my sister in law live in Portland, some of the family of my husband live in Atlanta so we have choices, but I don’t know where to begin, for example my baby can’t get the citizenship because a didn’t live 5 years in the US so I understand that I have to get him a cr2 but what i don’t understand is if I have to return alone to theUS  to start doing all of the paperwork I don’t want to be apart from my baby, I don’t know where to begin even, I know it’s going to be a really long process for us in particular because of the circumstances. Is there anyone out there in the same situation or at least kind of similar that can give me any advice?

I’m really desperate i don’t know what to do I’ve read so much about the CR1 that my brain is about to explode 😰

You start the process by mailing a petition package for your husband and one for your baby to an address in Chicago.  You can use DHL or FedEX.  Start preparing by clicking on the word "guides" at the top of any page of this site.  Then carefully study the applicable forms AND the form instructions. (Download both from the same page.)

 

Once you've done the homework, we'll be here to answer remaining questions.

Also I suggest you read the DCF guide ( http://www.visajourney.com/wiki/index.php?title=DCF_Mexico) for Mexico written and created by @Jorge V  It is specifically created for married US citizens with legal residence in Mexico.  Buen suerte!

Have you filed a Consular Report of Birth for your child with the US Consulate Merida?  If not contact them ASAP to obtain the necessary information for your registering your US citizen child  

prior to filing/submitting your I-130 application.

A CRBA is for children who are qualified to receive immediate US Citizenship through a parent.  This one is not, so a CRBA is a waste of time and money.

 

Note that it will likely be IR1 and IR2 visas rather than CR1 and CR2.  The child is definitely an IR2 no matter how long the couple has been married.

 

DCF in Juarez or Monterrey is also a good option.

Hi compadre I can’t I already talked with the consulate because my baby was born after July 12 2017 the requirements for the consular report are different now it doesn’t matter if you are the mother or the father you have to prove that you lived 5 years in the US 2 of which had to be after 14 years old

And thanks I didn’t know about the DCF I think that’s our way to go but I’m calling tomorrow to see if our case can be done that way because I have double citizenship, I hope we can do it that way, I’ll let you all know what they told me tomorrow... a little bit of light at the end of the túnel finally

That is not a change.  It's just a fact one of the posters ignored or was not aware of.

Double citizenship is not an issue but it is a good idea to contact them anyway.

According to recent comments by jcon91 in this thread, the CDMX field office is no longer accepting mailed petitions. This change seems to be very recent and their website does not reflect this new change. It's unclear if this applies to the other two field offices in Mexico. I'll update the DCF Mexico guide.

DCF Mexico

06/04/2017: Married

06/24/2017: Mailed I-130

06/27/2017: NOA1 (technically a RFE as we were missing beneficiary ID)

07/06/2017: NOA2

07/12/2017: Case assigned by Juarez embassy

07/17/2017: Packet 3 received

08/15/2017: Interview/Approval!

08/22/2017: Visa received via DHL

09/03/2017: POE

09/16/2017: Permanent Resident Card received

 

Total days from NOA1 to approval: 49
