Physical presence

I have us citizenship interview coming up and have a question regarding the travel. 

I have one trip of 176 days before n400 application and one after I applied for 176 days.

Is this gonna effect us citizenship. 

 

Do I have to show physical presence. I did not lease but sharing room while in US during the absence.

I was not working either. What kind of physical presence evidence I need to obtain if they ask.

What are the dates of the trips and when did you file the N-400?

Are you filing for citizenship under the 3 year or 5 year rule?

If those are your only trips, you probably will meet the physical presence requirement. However, you may or may not meet the continuous residence requirement.

I filed n400 sep 2017 and traveled (dec 2016-may 2017 176 days) and after filing (dec 2017 to may 2018 (176 days).

Physical presence should be fine then.

Depends on the dates of the trips. If they are close together, the IO can determine that you broke continuous residence.

Tough call...could go either way on continuous presence IMO. You were in the US only ~6 months over an 18 month period.

No not 6 months over 18 months. I have been 6 months over an year. (dec2016-may 2017 (out of USA) june to nov 2017 (USA).

dec2017 to may 2018 (out of USA) and since June 1 us.

Dec 2016 - May 2017 = ~6 months out of the US

June 2017 - Nov 2017 = ~6 months in the US

Dec 2017 - May 2018 = ~6 months out of the US

=> 6 months in the US over an 18 month period

oh yeah, thats right. Normally, for continuous presence, they generally look for trips over 6 months. I tried to come back before 6 months therefore. How shd i answer if asked

Correct that there is a presumption after 6 months. But per the policy guide linked above, they will consider multiple trips less than 6 months as well. IO's call here. Good luck.

The IO will probably ask you why you were outside of the US for that length of time, during both 6 month trips...truth is always the best answer....if you had a specific reason/specific proof, good idea to take any documents related to that to your interview if asked about it.  Off the cuff it looks like continuous presence was broken over the past 2 years but also depends on other factors.

 

With continuous/physical presence they will look at all trips over the past 5 years---even the shorter ones.  To get a better idea of how much the longer trips may affect your continuous presence, would be helpful if you could list all of your travel from the past 5 years (from date leaving the US to date entering the US)

To enumerate my last 5 years residence, travel and employment as a part of my N400 application process, I have filled up my N400 pdf form starting from my GC approval and continue to update it as and when there is a travel/change in my address/employment. This keeps us current with the dates required for N400 🙂

Just a trick to be alert with the dates.

HAH! That's pretty slick! All I've been doing is keeping track of my flight itineraries. 😂

I wish I'd kept track of mine over the years!  I couldn't even rely on passport stamps when it came time for my N400 since I've never had my current or expired passports stamped---ever.  Quite common for Canadians, but it slightly stressed me out when it came time for filing...all of my dates were estimated to the best of my recollection.
