06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

My fiance called her senator concerning my k1 case this is the Embassy's reply...

 

Dear Ms. Martin:

 

Thank you for your e-mail correspondence of October 1, 2018 regarding the K-1 immigrant visa application of Mr.xxxxxxxxx, as brought to Senator Flake’s attention by his constituent, Ms. xxxxxxxx

 

According to our records, the I-129F petition and the recommendation for revocation have been returned to the National Visa Center (NVC) to be forwarded to Department of Homeland Security’s U.S. Citizenship and Immigration Services (DHS/USCIS) because Mr. xxxxxxx failed to convince the Consular officer that he has a bona fide relationship with the petitioner.  While we are sensitive to your constituent’s concerns, we have no additional information on this case neither do we require any information from them at this time as this case is now considered closed in Lagos.  Since we no longer have jurisdiction over the case we suggest that they send any questions they may have directly to USCIS.  Public inquiries for USCIS can be made at 1-800-375-5283.  Useful information is also available on their website, www.uscis.gov

 

I hope this information is helpful in responding to the concerns of your constituent.

Omo Naija, this is your Ghana brother. I think you should abandon the fiancée visa route and your wife comes down to marry you and do the CR1 Route.

 

I believe your case however if you step back for a minute and evaluate it impartially, based on your previous marriage to an older American who filed a petition for you but died and it got revoked, then your B visa refusal, then you meeting another older American online, it will appear to an observer (consular officer) that your relationship might solely be for migrating to USA.

 

You have to force them to approve you, and in my opinion that can only happen when you’re actually married. With the fiancée visa, they have too much power/latitude to deny you.

 

You are a tough guy, you have gone through a lot. I am very impressed. Don’t back down.

Unfortunately the K-1 will not be processed any further and can not be appealed.

 

You will need to get married and file for a spousal visa.  You will need to provide better proof of a Bona Fide relationship amongst other things.  If there are issues with the CR-1 Visa and it is ultimately denied it can be appealed.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Timeline

I wrote the Embassy after 90 days as they said I should contact them, they replied me they said my case is out of their jurisdiction it has been return back to uscis for review.. So going for CR-1 without hearing their final conclusion could give me more issues. So I'm waiting to hear my final say from them since I'm still under administrative process and my case status still updating..
