I160a APPROVED Sample Letters Needed

Does anyone have any APPROVED I160a Hardship Sample Letters. I am in the process of writing mine. I need ideas of what to include. PLEASE, PLEASE any help will be greatly appreciated. GOD BLESS.

Which application are you filing the hardship waiver for?

What is the foreigner's inadmissibility?  (ie. overstay, criminal, etc.)

What is your relation to the foreigner?  (sibling, spouse or child)

What are your hardships based on (ie. medical, financial, etc.)?

 

More info is needed to give you proper advice.

I am filing the Provisional Waiver I160a,  I am the US Citizen spouse I believe that my hardship will be based on FInancial, family ties, etc.

Do you have any USC children together?  If so, make sure to mention their ages, and how being apart from the other parent will cause emotional and financial suffering (include anything in relation to any special education needs/medical needs of children that would not be met in the foreigner's country to the same standards).

 

For financial hardships, you'll want to include in your letter (and in your documentation) statements about your income, pay rates and cost of living, travel costs if you and any children were forced to travel to the foreigner's country for visits if separated, any lack of ability to recover from short-term financial costs created by the separation/move to the foreigner's country, list all expenses you have in regards to any financial support you give other family members (and provide proof of same), mention any decline in standard of living if you were to move to their country, etc.

 

Generally speaking, the hardship waiver should focus on the hardships you, as the USC, would face---they will not care much about any hardships faced by the foreigner.

 

Also note that whatever you say in the letter MUST be backed up by concrete evidence of your statements.  It's not enough to just say something---you must prove it with documentation.

 

Also, what is the country of origin of your spouse?  That has an effect on approval/denial, especially if the country is basically the same standard of living as the US, thereby a country you could easily move to.

You mentioned "family ties"---other than you, does the foreigner have any other relatives living in the US?  

 

Disclaimer:  The reason I keep saying "the foreigner" is because I have no idea if you/your spouse is male/female...or else I'd use he/she.

HE (foreigner)    and I have 3 children in common, besides that he has two brothers.

You can ask the children's teachers to write affidavits in terms of anything they've noticed about the kids in regards to emotional struggles being without their father, family reunification, etc. and include that with your package as well.  Pediatrician would be good to note if there are any medical issues with the children and how him living in the US cuts down on medical costs for you (once he is working)....that's if there are any medical issues with your children.

 

Are his brothers USCs or LPRs?
