I have been following VJ off and on in last 2 years. I filled my I 751 divorced waiver in Aug 2016, received NOA after 5 days and received fingerprinting appointment after approx. 2 months. I was unable to check my status online it didn't recognize my receipt number. I received a letter from local USCIS office on March 23rd for an interview. I had an interview on April 25th, 2018. My interview officer checked my documents asked some questions and at the end, he said I am going to approve your application. On May 1st, 2018 my status on USCIS website updated with "New card is Being Produced". On May 3rd it changed it to New office has Jurisdiction. I freaked out and called my lawyer and he called USCIS office and told me that your case is approved don't worry about online status as they transfer my case to national benefits center.  I got a letter in the mail it says that congratulations! we approved your application and you will get your green card within 60 days. after that I also receive a letter that my case was to transferred to NBC. After 21 days of my interview, i received my green card in the mail. 

 

Tips to prepare I 751 divorce application

 

write a very good letter and get a lawyer to help you in this process.

I took screenshots of my text msgs between me and my ex-wife

I also received RFE and I already submitted all evidence so I attached one more letter of support and sent all evidence again.

Attached 11 letter of support as I didn't have a joint lease and joint insurance.

 

Interview experience:

 

IO was really good he asked me about all the pictures and wrote it down about the event and when we took this picture. He asked my about my bank statement and asked the reason why we decided to get divorced. My lawyer went with me for an interview.

 

Most important point is true information if your case based on reality and facts then you should not be fear of anything. A good lawyer is very helpful.

Hi I'm glad a everything is good with you after divorce, I would like to make a few questions?, did you have your green card through marriage and you were removing conditions after divorce? Or your gren card was just aproved ? Domestic violence is the only reason why immigration approve a waiver after divorce? Thank you.

10 minutes with google and grade school reading comprehension would definitively demonstrate that domestic violence is not the only reason why immigration approve a waiver after divorce, as you put it. 

 

No, the waiver is approved as long as you can demonstrate that you did not enter into a fraudulent marriage in order to evade immigration laws (the burden of proof is on the applicant, with respect to this stage). 

 

If they deny it, then you are sent to immigration court, and retain status in the meantime. Once you are in immigration court, the burden of proof flips, and the government lawyer must prove that you entered into a fraudulent marriage, for the purpose of evading immigration law. There is basically no ###### way that they can prove this, especially not ASU-tier government immigration lawyers, and so there's no way you will get deported regardless of whether or not you committed marriage fraud. In this manner, it is demonstrable that, the entire ROC stage is a colossal waste of money, and ZOG job-creation program. Which we all knew anyway, but at least this time the charade is obvious.

I had to prove that my marriage was bonafide. Its not always domestic abuse. Also I got my green card after marriage but for waiver I had to fil I 751.

Thank you so much after 12y of marriage we are having BIG problems, Good to now there is Hope. We'll seek counseling to save the relationship and hopefully finally have kids. Thanks again God bless.

After 2 years of marriage you get permanent green card and for that you donot need a waiver. It only applies to those who recently got married means less than 2 years.

Thank you so much really I'm in same situation now I'm going through divorce and have conditional gc gonna be expired at March 2020 and I applied for divorce based on abused and cheating and it's the real fact but my question is any recommend about good lawyeror advice on my case bc I don't have any health insurance

I am in similar situation. I filed I-751 with divorce waiver in Sugust 2017, received RFE in March 2019 and still decisin is pending. May I know did you file 751 waiver based on good faith, abuse or both. My lawyer selected both option and my case is in VSC. Please shed some light. Thank you.

I filled in good faith. My lawyer told me that your marriage was real no need to submit under hardship. Good luck

@nevada16 hi, i saw ur post and i want to congratulate u first!!  just want to ask, when u responded to ur rfe, did u submitted again the same documents u have submitted before? and did u ask for an affidavit from ur ex too or its not necessarily? thank u for ur help..
