Immigration process with B2 Visa

I arrived the USA in February with a tourist visa, was planning to go back to Hong Kong in July. 
However, My husband proposed to me early April, we got married in mid-April and now I decided not going back to Hong Kong and stay in the USA.

 

As I know I need to file (if im not mistaken):

"I-130 (Petition for Alien Relative)"
"I-130A (Supplemental Information for Spouse Beneficiary)"
"I-485 (Application to Register Permanent Residence or Adjust Status)"
"I-864 (Affidavit of Support Under Section 213A of the INA)"
"I-765 (Application for Employment Authorization)"

 

I want to know if i need to file Form I-693 (Report of Medical Examination and Vaccination Record) as well?

 

Becos i found some of the posts said we need to file unless im holding a K1 visa, and some said it's no longer need since June 1 the I-693 will be only valid for one yeat from the time of the civil surgeon's signature and submission to USCIS. So it will be only filed when USCIS requested for it or through a notice to bring it to the interview.

 

If anyone know about this please let me know. I just want to have everything prepared well.

Only K-1 applicants can use medical records done overseas during K-1 process. You will need to do it in the U.S. as an adjustment applicant. You can either do the medical examination and include the sealed envelope result from the civil surgeon together with your adjustment of status package, or do it later and take it with you on the day of your interview. If you have your few hundred dollars to do it you can do it now and include it in the package. You have everything so far except your I-131 (advance parole/travel document). You should also include it just in case of an emergency travel, since adjustment of status will take several months. Besides it’s free when filed together with your I-485 so why not add it? If done your I-765 ( employment authorization document) will be a combo card that also authorizes travel as well as work authorization.

Yea I was thinking about that too. But then I'm looking at the form, in Part 2, which one i should select? And for Part 3, as i have no coming travel plan yet, i should leave it blank?

In part 2 you will select 1.d  which states “I’m applying for Advance Parole Document to allow me to return to the United States after a temporary foreign travel”. As for the rest of the other sections write “unknown” in the spaces where it asks specific information about dates of planned travel, lengths of trips etc.

Also i just got a new question, for all the forms do I put my husband last name as my last name (since we are married)?

I have a Chinese name (CHOW is my Chinese last Name, Pxx Yxx Polly is my Chinese First name -- Yea we don't have middle name).

My husband last name is CAMPBELL.

So how i input there? Do i still need to put my Chinese Last Name there?

It is totally up to you at this point which name to take, but if you do take his name then your other documents needs to be changed as well later after your EAD or green card is issued. At that point you’ll take the EAD or green card to the social security administration together with your marriage certificate and have it updated. You can use your Chinese last name as well if you wish to include it. Your little catch 22 will be when you book airline tickets using your names on your passport. You’ll have to carry a copy of your marriage certificate just to clear up any misunderstanding with airline agents regarding the last name on your green card which is his that don’t appear on your Chinese passport. However, this won’t be an issue if you chose to naturalize in the near future as your U.S. passport can legally have your married last name and your first name only.

Oh, so i can just do it AFTER my EAD and Green card is issued?

Or i can just start to use his last name for all the forms already?

Name change is a tricky issue with much to consider.

 

WHen you get married you are allowed to change your last name to your husbands last name. You can not change your first name or middle name. You can also add his last name to yours and have a hyphenated last name. You need to decide what name you want to use. Its a personal decision.

 

If you want your last name to be his and you want to stop using your previous last name you will fill out the AOS packet with his last name in the appropriate name spots. (or whatever hyphenated name youd like_) They will issue you EAD and GC in that name and change your name in the SAVE databases. When you get the EAD in his last name you can go down to SSA and get a new card with the new last name or an initial card with that last name. You then use the EAD and SS card to obtain or update your drivers license.

 

If you submit the EAD/AOS forms with your maiden last name all the documents (EAD and GC) will come with your maiden name. Therefore all the subsequent documents like SS card and DL will be in your maiden name. To change to his last name at that point you will need to pay apx 600 for a new greencard, go back to SS with it and motor vehicles and update the name. Or you can wait until ROC (2 years from when you get the GC) to change it on the GC then.
