hi everyone

 

 

me and my husband are recently married and are about to start the paperwork for our cr-1 visa

 

we talked to a lawyer that we are planning on hiring to help us through the process and while asking what questions we had about the visa process, the lawyer made it very clear I would be unable to visit my husband in the USA while the cr-1 visa is processing (im canadian living in canada and ill be the one moving to the usa to be with my husband) and that my husband will have to be the one to visit me in Canada rather then me visiting him in the usa

 

 

 

my understanding was that during the cr-1 visa I would be able to visit the usa (I usually go for just a week every 1-2 months and then come back home) just fine as long as I brought ties that ill be coming back to Canada. But every lawyer said even so, dont risk it and try, and they kept pushing my husband visit me and not me visiting the usa as it could disrupt the visa (somehow)

 

 

we have talked to multiple different lawyers and this what they all keep telling us.

 

I just thought I was able to still visit him in the USA (Its alot easier with my job to visit him then him visit me, so its abit of a hassle now for visits once we file)

 

 

 

anyone here aware of this (because I wasnt) or have been through this kinda of hassle before visiting on a cr-1 visa?

They must be confused. People going through K-1 visa can visit, so can CR-1 people. Like you said just be able to show proof of ties like you normally would. Of course you're subject to denial at entry point by customs if they seem it necessary; but just being in the process of a CR-1 won't be automatic denial.

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Find another lawyer.

Your lawyer knows very little. I suggest getting another lawyer or do the work yourself and save money.

 

I made numerous visits to the US after our petition was submitted. In fact it was a CBP officer who confirmed that my case was at NVC

 

I had zero issues. I stayed mostly 1 week each trip except for our anniversary where I spent 3 weeks. I also went to Canada and back during those 3 weeks and had no issues.

NOA1 - January 31, 2017

NOA2 - November 3, 2017

State Department - Sent November 7, 2017

NVC Received - November 9, 2017

Consular Interview - January 5, 2018

Port of Entry - Miami on January 19, 2018

 

ROC Mailed - December 14, 2019

ROC Rec'd - December 16, 2019

E-Notification - December 19, 2019

ROC sent to National Benefits Center (MSC receipt #)

Cheque cashed December 20, 2019

Ready to Schedule for interview - October 7, 2020

No ROC interview

New card is being produced - August 16, 2021
Card received - August 23, 2021

NOA - July 24, 2021

Biometrics - August 16, 2021
Interview - December 14, 2021
