hi when filling out my affidavit of support for my original petition my fiance was unemployed but is now employed will the government care if on my AoS we put her instead of her dad?

Mate I was in the same situation.. USE BOTH. It is a bit more work initially but it will save you time later and make it a smoother process.. they will never reject you for having too much support

As long as the sponsor makes enough money, they don't care whose name is on the affidavit of support. When we did the initial K-1, my dad was a co-sponsor since I was in college. By the time we filed for AOS, I had a new job lined up so we didn't need to use my dad as a co-sponsor.

The K1 visa is over. You have started a new process from scratch. Use only your husband if he makes enough income.

You are in a new process from the K1, if you are now moving onto AOS.

Your spouse will ALWAYS be your sponsor, and as such they will have to fill out the financial support form (I-864) regardless of if they are employed or not. If you are using a joint sponsor, they would have to fill out their own I-864 too. If your spouse is now employed and makes enough and can provide all the financial evidence in the instructions, then only she will fill out the form.

all this info is super helpful guys thanks :) so my now wife is a contractor and has only had the job since january, while she definitely makes enough money she isnt a salaried employee, our only difficulty is figuring out how to prove she makes enough i think

If she is self-employed and just started in Jan she wont meet the requirements. Self employed needs to have one years tax return. Employees do not. They can submit paystubs showing current income. (If she gets paid on 1099s shes self-employed. If she gets w2s shes an employee). You will most likely need a cosponsor although like stated above she will still need to fill out the 864 with her current income. It just wont be considered sufficient.
