Why don't you get it from the Indian Consulate in SFO? http://www.cgisf.org/page/display/105/236  (costs $28)

Have you heard of any case where uscis accepted this document? I read somewhere that this document from local indian consulate is not accepted by uscis.

Actually, that's incorrect, if a person in India is born before April 1, 1970, a "non-availabilty of birth certificate"  (NABC) is NOT required. That's because that's the date the Registration of Birth and Death Act, 1969 became active for most of India which made registering birth mandatory. The NABC is required if one doesn't have a birth cert. if born *after * April 1, 1970. The State Department/USCIS very well knows about it!. See https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/India.html.  If born before April 1, 1970 and the birth certificate is not available or is incomplete/late registered then, two affidavits from someone older than the person who can attest to have personally known of the birth and one or two secondary documents if available (such as school/college leaving certificate or some early government document with the birth date) should be good enough.

Now not sure why USCIS is requesting it in an RFE (if born before 1970) but if it is difficult to obtain one - these facts can be pointed out to them.

How sure are you? Since in the RFE they mentioned that NABC is required along with secondary evidence. I didnt want to take a chance, sorry i might be wrong. Do you know if any such cases got approved without providing NABC.

Thank you!

The Birth Certificate I've read is not but the NABC should be.

I think it depends upon the completion of the biometrics. Have they completed their biometrics? If so, how long ago?

Update for my parent’s 130, 765, 485 concurrent filing:

Dad: his 130 and 485 are still pending but he got his EAD card (765) yesterday which is very confusing. I thought 130 approval comes in first.

Mom: her 130 is approved and we received rfe for her 485 ( i was sooo nervous about this but apparently the rfe was bec the doctor didn’t sign a page in her medical form - aaarrggh!). We already responded a month ago but her 485 status hasn’t change - still says “we request for additional doc...” I do have the fedex tracking that it was delivered... does it change for you guys when you respond to rfe?

Thanks for responding. Was planning to call them on Monday but I got a text message update for my mom’s 485 late yesterday afternoon and it said it’s now in Card/Document Production.
